The bike and/or demonstration material are provided for testing purposes for the specified date and times expressed by the Pivot Cycles staff. The participant undertakes to handle to bike and/or demonstration material for testing purposes carefully and shall not leave the bike and/or demonstration material for testing purposes unattended at any time. The participant shall not give the bike and/or demonstration material for testing purposes to a third party temporarily or at any time.

Negligent or intentional damage to or loss of the demonstration equipment will be charged to the participant at Pivot Cycles retail price.

The participant is fully aware of the aforementioned risks and any other risks in the context of his/her participation in the Pivot Cycles bike testing program. The participant is also fully aware of the general risks of bike usage, including but not limited to risks related to it arising from physical strain, forces of nature, accidents, travelling by any means of transport, appropriateness of medical facilities and/or negligence on the part of one of the parties or third parties.

 

The participant (i) waives any causes of action, legal actions, lawsuits, verdicts, damages, claims and receivables that the participant has, could have or will have or that minors, heirs, executors, trustees or proxies have, could have or will have due to any matter, cause or issue arising from the use of Pivot Cycles equipment or related to it or arising from the participation in the Pivot Cycles testing or demonstration program and (ii) indemnifies Pivot Cycles and its owners, staffs, representatives, and successors from the aforementioned. This does not apply to claims due to gross negligence or the intentional misconduct on the part of Pivot Cycles.

The participant is informed and agrees that Pivot Cycles has no control over the operation of bikes on the part of the participant and that Pivot Cycles shall not be held responsible and shall not be held liable for injuries, damages to property, liability or other losses, accidents, delays, inconveniences or irregularities that may arise from either (i) unlawful, negligent or accidental acts or omissions on the part of the participant or (ii) unlawful, negligent or accidental acts or omissions on the part of another party that is not subject to immediate control of Pivot Cycles.

The participant undertakes to wear a CPSC bicycle helmet during the test rides in order to reduce the seriousness of an injury in the event of an accident.

I hereby also express my consent that Pivot Cycles, 1807 West Drake Drive, Tempe, AZ 85283 may use my personal data (given name and surname, postal code and city, telephone number, and email address), that was collected in the context of my participation in the Pivot Cycles bike testing program, to inform me by email, or phone of any product updates to be released.  Your information will not be sold, exchanged by Pivot or Pivot Cycles Partners for any reason whatsoever. If at any time you choose to unsubscribe, detailed unsubscribe instructions are included with every communication.

I represent that I am an experienced bicycle rider and regularly ride equipment similar to the demonstration equipment with quick release, clipless pedals, gearing and brakes and all other mechanical functions of this demonstration equipment and will not modify or adjust any of this demonstration equipment. 

I further represent that I am not and will not be under the influence of any alcoholic beverage, of any drug or medication and do not have any ailment or condition which effects or impairs my balance, vision, coordination, or other ability to properly and safely operate a bicycle or demonstration equipment.

Knowingly and assuming these risks, I agree to waive, release and discharge any and all claims for damages for death, personal injury or property damage which may occur from any cause whatsoever, including negligence of Pivot Cycles, or its agents and employees, in connection with my and/or my minor child(ren)’s use of this bicycle or bicycle equipment in the Pivot Cycles, bicycle testing program.

 

I confirm that I have read and understood the terms and conditions of Pivot Cycles, as displayed at the point of sale. Furthermore, I confirm that the bike(s) are my responsibility whilst in my possession. I ride them at my own risk.
