Terms and Conditions – SCOTT Experience Tour 2023
1. The organizer of the SCOTT Experience Tour is SCOTT Sports SA (hereafter SCOTT), with registered office in Givisiez, Switzerland. The SCOTT Experience Tour (hereafter Tour) takes part at various places around Europe, whereas SCOTT-Partners as well as individual persons interested in biking can borrow and test a SCOTT bike during individual time slots of the SCOTT Experience Tour free of cost. These Terms and Conditions apply between SCOTT and you, respectively each participant of the Tour. You are allowed to make a booking for a third person, however any person (hereafter Participant) borrowing a SCOTT bike for a Tour will be requested to sign these Terms and Conditions again, before receiving the SCOTT bike.
2. The minimum age for the participation at the Tour is 18 years.
3. SCOTT will provide the elected SCOTT bike to the Participant for the time slot booked. The Participant is obliged to bring his/her own cycling equipment, in particular a bike helmet, sportswear, cycling shoes and pedals (in case the Participant does not intend to use SPD cleats).
4. The booked time slot of the Tour will expire in case of late arrival of the Participant.
5. In case the Participant’s Tour is guided, the Participant is obliged to follow the guide and the route proposed by the guide.
6. The Participant is requested to use the SCOTT bike with due care. Any fall, crash or accident occurring during a Tour must be reported to SCOTT latest when returning the SCOTT bike. The same applies in case the Participant becomes aware of any defects on the SCOTT bike during the Tour. Damages caused on a SCOTT bike by the Participant in a negligent or intentional way must be reimbursed to SCOTT by the Participant.
7. Each Participant of the Tour will be asked to deposit his/her identity card or passport prior to receiving a SCOTT bike. The ID can be picked up by the Participant when returning the SCOTT bike.
8. The Participant is aware that the participation in the Tour respectively rides with the SCOTT bikes can be linked to physical activities and great physical exertion. The participation at the Tour can lead to accidents with injuries and damaged property of the Participant. A bike helmet must be worn during the entire Tour. The Participant declares that he/she feels physically and physiologically ready to take part in the Tour. The Participant agrees that the liability of SCOTT and companies affiliated with SCOTT for damages and/or injuries that may occur to the Participant or that are caused by the Participant because of his/her participation in a Tour is, as far as legally possible, excluded. The Participant confirms that he/she is insured against accidents. In case of recourse, the Participant must indemnify and hold harmless SCOTT Sports SA against claims of insurers.
9. Disputes relating to the participation in the Tour are subject to Swiss Law under the exclusion of all norms that refer to foreign law. Berne in Switzerland shall be the place of jurisdiction for all disputes relating to these Terms and Conditions and/or the Participants use of a SCOTT bike.
