Gippo Bike
Rental Terms and Conditions
The Supplier hereby agrees to rent to the Renter, and the Renter hereby agrees to rent from the Supplier, the Equipment specified above, that include the vehicle/s and eventually the helmet/s and accessories (written on the “Extra” field), upon the Terms and Conditions contained in this Agreement.The Equipment is let out on hire. The Equipment remains the property of the Supplier and the Renter will not sell or hire it.
Before taking possession of the rented Equipment and signing the present Agreement, the Renter must check that all the Equipment functions properly and is in adequate conditions; otherwise he must report it to the Supplier.
In the event that there are multiple users of the rental Equipment, the Renter accept complete responsibility for those additional users, according to this contract.
The Renter will ensure that the Equipment is parked in a safe place and/or padlocked when not in use.
Scooters are insured with a maximal of 10 000 000,00€ of motor vehicle liability. For damages in excess of the insurance coverage will be responsible for the Renter of the vehicle. Fire and theft insurance are not provided on scooters either on bikes, therefore in case of such events the Renter is required to pay the same value of the rented vehicle/s, referring to the assessment of Blu Eurotax. In case of fire or theft, the Renter is liable of report the event to the local Authorities and to provide Gippo Bike the original copy of the report within 24 hours. Gippo Bike has an insurance regarding damage to third parties with a maximal of 3 000 000,00 €.
The Renter will pay directly to the authorities or to Gippo Bike di Sbandelli Adriano the amount of any penalties or other taxes deriving from the use of the vehicle/s during the rental, exonerating Gippo Bike di Sbandelli Adriano of all involvement.
The Renter authorizes Gippo Bike di Sbandelli Adriano to charge on their credit card the amount of any penalty, traffic offense and damage caused to the rented vehicle/s or loss of the Equipment.
The Renter undertakes to drive and to maintain the vehicle/s and its/their accessories with care within the rules of the Highway Code, in particular:
- The driver must have a valid driver license to operate the scooter.
- Helmets are mandatory in the State of Italy to circulate on motorcycles. Gippo Bike supplies the helmets.
- Only the Renter is allowed to drive the Vespa.
- Perform normal maintenance, lubricant checks and brake oil.
- The Renter will not drive under the influence of drugs, narcotics, alcohol or intoxicating substances.
- Contact immediately Gippo Bike.
- Inform the nearest police station.
- Take the name and address of the other driver/s involved in the accident.
- Inform Gippo Bike of any other important details.
- Contact immediately Gippo Bike.
- Follow the instruction given from Gippo Bike. Don not make any repair without authorization from Gippo Bike.
A rental day is considered from 9:00 AM to 7:30 PM or up to the time of return established by this contract.
The Supplier may repossess the Equipment in its sole discretion, even against the wishes of the Renter, and there shall be no refund to the Renter of amounts previously paid.
The Renter will return the Equipment to the Supplier at the designated place, by the time agreed on the contract. If the Equipment is not returned by this date and time, with a tolerance of 30 minutes, one or more day of hire will be charged and the Supplier will be allowed to repossess the Equipment by any means deemed necessary, even against the wishes of the client, who will refund Gippo Bike di Sbandelli Adriano for an eventual cancellation caused by this delay. In case of Vespa rental, if the keys are not delivered back, because of theft or loss, the Renter will be charged the amount of 150,00€. All scooters are provided with Vehicle Registration. The non-delivery of the original copy of the Vehicle Registration of the scooter caused by theft or loss, will obligate the Renter to sustain all the charges for the emission of a new Registration of the scooter of 180,00€.
The Renter will be held responsible for loss or any damage found on the Equipment when returned, even if said damage is caused involuntarily or even if the Renter is not legally responsible for said damage. The Renter must reimburse the Supplier for all the possible expenses that the Supplier might have to bear in order to repair or buy again the Equipment.
Any belongings left in the vehicle/s after the return to the Supplier will be consider abandoned and the Supplier is not obligated to keep or return them to the Renter.
Eventual controversies will be handled exclusively by Court of Siena.
The Renter is authorized to use the Equipment only within the State of Italy.
Gippo Bike accepts cash or credit card as form of payment, that needs to be effected at the time of the delivery of the Equipment.
This Agreement will be governed by and construed in accordance with the laws of the State of Italy. Gippo Bike, its agents and employees are exempt from all liability whatsoever for personal injury, property damage, or death caused by negligence of any party. The Renter assumes all risks due to the use of the Equipment.
The Equipment can only be rented by persons aged 18 or older upon presentation of some form of legal identification. It can be rented to minors only upon presentation of a written declaration by a parent or legal guardian of the minor that authorises the use of the equipment by the said minor; said declaration must be presented before the Equipment is rented. The supplier accepts no responsibility whatsoever.
The scooters are rented with a full tank and should be returned with the same quantity of fuel. If not, a refueling service of € 5.00 will be charged in addition to the cost of the missing fuel.
No reimbursements will be made if the booking is cancelled from 10 working days before the start of the rental.
