The customer hereby rents bicycles from Cycle Malaga subject to all terms and conditions of this agreement:
1. The daily rental period is from 9.30 am to 5.30pm Monday to Saturday. We are closed on Sundays and between 1.30am and 3.30pm Monday to Saturday during the winter. Summer hours are 8.30 to 2.00pm Monday to Saturday.
1.2. If the customer fails to return the rented items to Cycle Malaga within the agreed rental period, even for reasons beyond his/her control, Cycle Malaga shall be entitled to demand compensation.
1.3. The rented items will be delivered / picked up on time and date according to the previous booking. The customer has to give clear information about the meeting point and place to deliver / pick up the rented items and provide a functioning mobile number.
1.4. Any changes to the rental contract must be notified by the customer and confirmed by Cycle Malaga. Any delays on delivery / pick up of the rented items will result in an additional charge to the customer.
1.5. Exceptional circumstances or force majeure could lead to delay of delivery/pick up of the rented items. In such cases Cycle Malaga will always notify the customer about the changes.
1.6. All rented items are presented in perfect working order. Cycle Malaga accept general wear and tear during the rental period. However, any bicycle/equipment returned with excessive cleaning requirement will result in a 10€ charge to the customer.
1.7. The rented items should only be used by the designated customer and the members of his/her party as mentioned in the rental contract. The customer accepts to use the rented bicycle/equipment with all due care and correctness in order to observe road safety regulations. Customers are forbidden to use any rented bicycle under the influence of alcohol or drugs. Customers are not allowed to modify or alter the rented item in any way.
1.8. The customer is obliged to take good care of the rented equipment and to protect it from damage, loss or theft. In case of damage, loss or theft of the bicycles, components or any of its parts, Cycle Malaga will charge the customer the full cost of the missing items at market prices.
2. Reservation
Bike reservations must be completed prior to the rental period. If the customer urgently needs a bike on the same day a reservation can be made over the phone or by email.
3. Payment
3. 1 The customer must pay the full amount for the rented items on booking.
3.2. No shows will be charged in full, and considered non‐refundable. Exceptions to this policy cannot be made for any reason.
3.3. Cycle Malaga does not provide a refund for early return of rented items. Cycle Malaga cannot be made responsible for the customer´s personal circumstances, sicknesses, weather conditions or any other event of force majeure. The customer accepts that no refunds will be made for any of the above reasons without any exceptions.
3.4 Cycle Malaga does not provide refunds for full or part payments given prior to bike hire for any circumstances.
3. Cancellation

7 to 14 days 25% Cancellation Fee 75% credit for future rental, tour or holiday
0 to 13 days 100% Cancellation Fee
4. Deposit
4.1 Upon delivery or Shop Pick Up of the rented items the customer must read, accept and sign the rental agreement. The security deposit is 200 Euro for mechanical shifting and 400 euros for DI2 Electronic shifting, 100euro for a mountain bike and 200 euro for an E Bike. The Customer signing the rental contract must be over 18 years old. At the end of the rental period, the customer accepts the charges for any missing or broken items at market prices. The deposit will be refunded if the rented equipment is returned in the same conditions it was procured. If the missing or broken items exceed the deposit amount, the customer must settle the balance.
4.2 If Cycle Malaga private Insurance is paid which is 30 euros for DI2 Electronic shifting bikes and 20 euros for mechanical shifting for up to 7 days and then 2 euros per day thereafter, there is no need to pay a security deposit. There is a 50 euros excess. (The insurance does not cover a broken or cracked frame or if the bike is stolen). This can be paid on receiving the bike.
4.3. The customer accepts the charges for any missing or broken rented items at market prices at the end of the rental period agreed in the contract. If the missing or broken rented items exceed the deposit amount, the customer must settle the balance.
4.4 The customer is obliged to make provision for the protection of the rented items, as well as the protection from loss and theft. In case of theft or loss during the rental period, the customer has to bear all the costs for the reconditioning at market prices. From the moment of signing the contract and receiving a rented item, the customer is fully responsible for the rented items.
4.5 In case of theft or loss of the rented bicycles/equipment, Cycle Malaga applies a charge of 3,000€ per Carbon Road Bike 1,000€ per Mountain Bike and 2,500€ per Electric Mountain Bike.
4.6 If the rented item is found after it was stolen, Cycle Malaga will contact the customer and payment will be funded.
5. Cycle Malaga recommends customers to have Travel Insurance that covers rented items against loss, theft & damages. In case of theft or damage, Cycle Malaga will do their best and cooperate with the client's insurance.
6 Small reparations on rented items as punctures is the customers responsibility. Regarding all other repairs on rented items during the rental period, the customer must contact Cycle Malaga and agree on the service charges.
7. Cycle Malaga has third party liability insurance coverage of the bicycle rental activity. Cycle Malaga is not responsible for injury or damages caused to/by the client during the rental period.
8. The customer is responsible for sufficient personal insurance coverage for risks that may occur during the rental period. Cycle Malaga is not liable for any claims for body injury or harm, accidents or loss of personal belonging caused by weather, sickness, persons, cars or any other causes and causes.
9. The customer must respect Spanish traffic regulations. Any ticket or fine due to incorrect use of the bicycle will be completely assumed by the customer. Customers must wear a helmet at all times when cycling as required by Spanish law.
10. All the information provided by the customer to Cycle Malaga is protected by the law 15/1999 of 13th December regarding the protection of personal data.
11. The provisions of this contract shall be governed by Spanish law.
