To obtain the rental of a pedal assisted bicycle, the user must present in advance to the company EBIKEGARDA Srl the driving license, or a valid identity document, a non-rechargeable credit card: the
copy of the identity document will be retained from the manager until the end of the rental; for the
payment of the deposit the customer can alternatively make a pre-authorized debit on the credit card,
or, pay a deposit of € 250 in cash.
2. The use of the bicycle presupposes the physical fitness and the technical expertise of those who
intend to lead it. Therefore the user by renting the bicycle declares to be equipped with adequate
capacity and appropriate competence without placing any reserve. In the case of use by minors with
the signing of this contract, the custodial parent or guardian of the minor assumes all the
responsibilities indicated in this contract and the civil code, consequently authorizing the child to use
the bicycle under the conditions provided for by this regulation.
3. The bicycle is to be used exclusively as a means of transport and to be treated with care, common
sense and diligence, in order to avoid damage both to itself and to its accessories. It is forbidden to
use the bicycle to carry out commercial activities and it is possible to transfer it to other subjects.
4. The user is responsible for the electric bicycle until it is returned to the operator, is also responsible
for damage caused to himself, the bicycle, third parties and things during the use of the vehicle. No
form of compensation can be requested from the manager.
5. During the rental the user does not enjoy any form of insurance nor the electric bicycle is covered by
RC insurance. The user is therefore required to comply with the rules of the highway code. The
manager declines all responsibility in case of improper use of the vehicle or failure to comply with the
rules of the highway code.
6. The operator can check users during the use of bicycles and can request a return if he finds the
conditions of improper use of the vehicle. The manager can refuse the rental to people in a state of
drunkenness or under the influence of drugs (in accordance with articles 186/187 of the highway code)
and for other reasons at the sole discretion of the manager himself.
7. In case of loss of keys, bicycle accessories or damages, the manager will ask the customer for the sum
necessary for the original restoration of the bicycle, on the basis of what is stated in this contract or, in
the absence of the price list, and the supplier's estimate, in the event of total theft, the user must
compensate the manager for the amount set at € 2,500.00 for each bicycle.
8. The bicycle must be returned, respecting the times indicated in this contract, in the same place where
it was chartered. The bicycle is considered returned only if returned directly to the manager with the
counter-signature of the redelivery of the contract; the parking of the electric bicycle outside the
rental point during the closing time can not be considered. Failure to return the bike without prior
notice or in any case not motivated by exceptional cases will be considered as a crime of theft and
therefore reported to the judicial authorities.
9. The user can ask the operator for an intervention to collect the bicycle, the cost of which is indicated
in the contract; the manager is not required to intervene, so the failure to intervene can not be the
cause of breach of contract. It is in the interest of the manager to collect the bicycle, and only
temporary contingencies can make the intervention impossible.
10. The user must pay the corresponding payment from the time the rental starts until he / she is present
for the closing of the rental contract, as well as any charges for damages, total or partial thefts
11. In case of theft of the electric bicycle, the user must present to the manager a copy of the report
made to the competent bodies and pay the amount equal to the value of the bicycle object of the
theft (see item 7) which will be returned in case of finding or recovery of the vehicle itself.
