General Provisions
Unless expressly agreed otherwise, these General Terms and Conditions (GTC) shall apply to all transactions between Epic Snowsports GmbH and its customers. The company’s business operations include running a snowsports school, a bike school, an online shop (epic-shop.ch/epicshop.ch), The Epic Shop Priva Alpine Lodge (Dieschen sot 18, 7078 Lenzerheide), and The Epic Shop Revier Mountain Lodge (Voa Principala 84, 7078 Lenzerheide).
The services offered include snowsport lessons and guiding, bike lessons and guiding, equipment rental, equipment maintenance, and the sale of goods.
Legal Capacity
When entering into a contract, the customer confirms that they are of legal age (i.e., 18 years or older) and, if acting as an entity or representative, are duly authorized to enter into the contract. If this is not the case, the customer is liable for the consequences of the contract's invalidation and any resulting damages.
Rental
Customer Identification on Site
Before the rental item is handed over, the customer must present a valid photo ID (e.g., passport or driver’s license) at the rental shop and their (printed) booking confirmation. The customer agrees that a copy of these documents may be made.
If the rental shop has any questions regarding the age of children or adolescents for whom the customer is renting, an official photo ID must be presented to verify the stated age.
Collection and Return of Rental Equipment
The customer can collect the rental equipment from 08:30 on the first rental day. The equipment must be returned by 17:30 on the last rental day. For any returns after 17:30, an additional day's rental fee will be charged.
Rentals made after 16:00 (except for bikes and sleds) will be charged from the following calendar day. If the rental item is returned before 09:00 (except for bikes and sleds), the current day will not be charged.
If the rental items are not returned within 5 days after the rental period ends and the renter does not contact the shop within this time, theft charges will be filed without further notice.
Defects
The customer must inspect the rental item immediately and on-site for defects. If the item has defects upon handover, excluding minor wear and tear, the customer can withdraw from the rental if the rental shop cannot fix the defect or provide an equivalent replacement. Otherwise, there are no warranty rights.
Later discovered defects must be reported directly to the rental provider. If the customer fails to report the defect within 24 hours, they are liable for any damage resulting from this failure.
The rental provider must inspect the returned rental item immediately and on-site for defects after return. If the defect is not reported within 24 hours, the rental item is considered returned without defects.
Liability
The rental equipment is not insured.
The customer is fully responsible for the rental item and must use it according to its function and intended use. The customer may not alter the sports equipment settings made by the rental shop.
The customer is responsible and liable for returning the rental equipment in a usable condition. They are not liable for defects and wear that occur from intended use. However, if the equipment has defects beyond normal wear and tear or storage conditions, the customer is liable for repair costs or, if repair is not possible, for the full sale price of the damaged equipment.
The customer must ensure the equipment is handled so it is not accidentally exchanged, stolen, or lost. If the rental item is accidentally exchanged, stolen, or lost, the customer will be charged the full sale price of the item.
Transfer of Rental Equipment
The customer may not transfer the sports equipment to third parties.
Delay in Collection
In case of delay in picking up the rented equipment, the customer should inform the shop as soon as possible. The reserved equipment will be held by the shop for up to 4 hours after the rental start time on the first rental day. After this time, the equipment will be made available for rental again, and the customer will not be entitled to any compensation.
Cancellation of Reservation
All reservations for rental equipment can be canceled free of charge by 17:30 on the evening before the rental. Cancellations must be made in person at the shop or in writing (info@epic-lenzerheide.ch).
For no-shows or late cancellations, we reserve the right to charge the full amount.
Early Return
Early returns of rental items are only accepted due to injury and only if the item is returned as soon as possible. Early returns due to bad weather are not accepted.
Rental Price
All prices are in Swiss Francs (CHF) and include all taxes applicable at the time of booking.
Snowsport and Bike Lessons/Guiding
Booking/Reservation of Lessons
Both on-site reservations and online reservations are considered confirmed bookings.
Cancellation of Lessons
Cancellations of lessons/guiding must be made in writing (info@epic-lenzerheide.ch) at least 48 hours before the course start. Otherwise, the full fee according to the booking will be charged.
Refunds are only given for timely cancellations. There is no refund for late arrivals or early termination of lessons.
In principle, snowsport instructors/bike guides conduct lessons in all weather conditions. Epic Snowsports GmbH reserves the right to modify, cancel, or terminate the program during the activity if natural and/or weather conditions or other unforeseen circumstances (force majeure, official or safety measures, or other risks) require it.
If the lesson is canceled for the above reasons, a proportional refund will be provided.
In case of an accident/illness or other hardship, the guest’s cancellation insurance (if taken out in advance) will cover the costs. The participant is responsible for claiming the refund. We recommend that all customers take out appropriate insurance.
Liability
Snowsport activities and mountain biking are dangerous sports. Epic Snowsports GmbH is not liable for accidents, injuries, or death of guests. It is the responsibility of the guest or responsible adult to decide whether to take the risk. Participants are responsible for taking out accident or liability insurance.
Epic Snowsports GmbH is not liable for damage or loss of equipment or personal belongings.
Prices
All prices are in Swiss Francs (CHF).
(Online) Shop
Epic Snowsports GmbH operates a shop at the Priva Alpine Lodge in Lenzerheide, at the Hotel Revier Lenzerheide, and an online shop (epic-shop.ch/epicshop.ch). In the context of sales contracts, Epic Snowsports GmbH is hereinafter referred to as the seller.
Conclusion of Purchase Contract
Product displays in the online shop are considered offers for a contract. By clicking the "place order" button, the customer submits a binding offer.
Order confirmation is sent via an automated email immediately after the order is placed and does not yet constitute a contract. The contract is formed upon delivery of the products.
In the physical shop, a sales contract is concluded as soon as payment is made.
Prices
All prices are in Swiss Francs (CHF) and include all taxes applicable at the time of booking.
The listed online discounts and/or discount codes cannot be combined.
Delivery
Unless otherwise agreed, the products will be delivered from the warehouse to the shipping address provided by the customer.
If the ordered product is unavailable because the seller is not supplied with this product by its supplier through no fault of their own, or other obstacles such as force majeure and resulting bottlenecks in our supply chain arise, the seller may withdraw from the contract. In this case, the customer will be informed immediately. If the product cannot be delivered, the seller will promptly refund any payments already made.
Returns
If the customer wishes to withdraw from the purchase after receiving the product, they must notify the seller within 14 days of receiving the product and return it within the same period (14 days from receipt of the product).
An item can only be returned if the product is free of defects and damage, and it is returned in its original packaging with the delivery note. The return shipping costs are borne by the customer.
Items excluded from exchange include ex-rental products (such as winter sports equipment and mountain bikes), (ski) underwear, hygiene masks, food, and discounted items.
Adjustment of Ski Bindings
If a binding adjustment is made to skis, the following applies: Ski boots will be fitted to the ski binding if the customer’s ski boots are available. Only then do the binding settings meet the safety requirements of the Swiss Council for Accident Prevention (ISO-Norm 11110). If your ski boot is defective or has worn-out soles, this could result in different values.
Applicable Law and Jurisdiction
All obligations are subject to Swiss law. The exclusive place of jurisdiction is the headquarters of Epic Snowsports GmbH.
Severability Clause
If any provision of these GTCs is deemed illegal, invalid, or unenforceable for any reason, the validity of the remaining provisions shall not be affected. Unless otherwise agreed, the invalid provision shall be replaced by a valid provision that closely reflects the economic purpose of the provision and the intent of the parties at the time of the contract. The same applies to any gaps in these GTCs.
