TERMS AND CONDITIONS
TY Cycles Ltd
These Terms and Conditions form part of the Hire Agreement made between you (the person who is party to the Hire Agreement) and TY Cycles Ltd of Units 39 & 40, The Spinney, Elmsfield Industrial Estate, Chipping Norton, OX7 5XL, United Kingdom (“we”, ”us”, and “our”).
By signing the Hire Agreement, you confirm that you have carefully read and voluntarily agree to these Terms and Conditions, and that all members of your group using the Hire Equipment are aware of the same.
Bookings, Collection, and Return
1. Bookings are paid for either online via tycycles.co.uk or upon collection. You will receive confirmation shortly after making your booking, and a receipt can be produced upon request after payment in store. On collection of the Hire Equipment (defined below), a copy of your ID (such as a passport or driving licence) will be taken.
2. All Hire Equipment, which includes hire bikes, helmets, locks, map holders, pannier bags, and chargers for e-bikes if applicable (“Hire Equipment”), is regularly maintained and inspected prior to each hiring. By accepting the Hire Equipment, you agree it is in good technical, safe and clean condition and must be returned as such. You must report any damage prior to setting off, as you may be held liable for any damage to the Hire Equipment upon return. The Hire Equipment remains our property, and you are not permitted to sub-hire it or allow it to be used in a way that is unlawful, unsafe, or renders invalid any insurance policies.
3. We will examine the Hire Equipment on return for any damage. If for any reason a full inspection cannot be undertaken, we reserve the right to inform you within seven days from the date of return of any damage found and to invoice you accordingly (see ‘Damage to Hire Equipment’).
4. Unless previously agreed with us and subject to the terms of the Hire Agreement, all Hire Equipment must be returned between 8:30am and 5pm on Monday to Friday (or 4pm on Saturday). You will be charged for an additional day’s hire for Hire Equipment returned later than the agreed time. Full or partial refunds will not be given for the early return of hire bikes under any circumstances, including adverse weather conditions.
Cancellations and Refunds
5. You will not receive a refund if you cancel your booking less than 24 hours prior to the start date of the hire period for whatever reason, or for costs incurred by you for punctured tyres or damage to the Hire Equipment. Bookings cancelled more than 24 hours before the start date of the hire period will be eligible for a 50% refund. In the extremely unlikely event that we have to cancel your booking, you will receive a full refund.
6. In the event of a puncture, we offer a breakdown service at a fixed charge of £60.00. Please contact us on 01608 238150 or email us at the address below on Sundays if you need this service.

Safety and Correct Use
7. We strongly recommend the use of safety helmets which are provided by us, and you acknowledge this recommendation. You assume full responsibility for any accident, injury or death which may occur as a result of you or others in your group taking the decision to ignore this recommendation and using the hire bikes without using a safety helmet.
8. All persons under 18 years of age MUST wear a safety helmet, be competent cyclists, and be accompanied by a riding adult at all times. Under UK law, e-bikes are not to be ridden on public roads by those under 14 years of age. If the e-bike is hired by an adult for a child under 14 years of age, it is entirely the adult’s responsibility to ensure the e-bike is ridden legally at all times.
9. It is a criminal offence to ride a bike on a road or in a public place while being unfit through alcohol or drugs. You agree not to ride the hire bikes after consuming, ingesting and/or using alcohol or drugs and/or with a blood alcohol concentration above the legal limit.
10. You understand that cycling can be dangerous and accept the serious potential risks involved. Safe cycling is dependent on your alertness and good judgment. We provide hire bikes on the understanding that EVERY rider can operate the bikes correctly and safely. You confirm that you and your group are ALL competent cyclists and recognise that you must exercise additional care and attention when riding bikes with which you are not familiar.
11. By signing the Hire Agreement, you confirm you and your group are in good health and there is no reason to believe you are suffering from any medical condition or disability that may adversely affect normal control of the hire bikes when cycling. You also agree:
a. To follow the Highway Code and UK traffic laws.
b. To be courteous and respectful to other road users and the surroundings.
c. To cycle sensibly and not undertake manoeuvres beyond your level of skill or fitness, or beyond the design purposes of the Hire Equipment.
d. Not to cycle in the dark unless you have fitted your hire bikes with lights, bells and reflectors.
e. Not to carry more than one person per bike.
f. Not to ride e-bikes through deep water or streams (water ingress will damage the motor and battery).
12. We recommend that you or someone in your group carries a mobile whilst cycling. You can contact us on 01608 238150 or by email at the address below on Sundays. For emergency services contact 999.
13. All e-bikes are supplied with a fully charged battery. There is no guarantee the battery will last all day. The battery life depends on how the bike is ridden, the route chosen, and the modes of assistance selected. E-bikes have a full range of gears that must be used in conjunction with the “power assist” modes. In the unlikely event that the battery runs out, it is possible to pedal unassisted. Economic use of the e-bikes is fully explained and demonstrated on collection.
14. If hiring for more than one day, e-bikes are supplied with a charger and the charging process is fully explained. You are responsible for charging the e-bike battery (which must be done under cover). Electrical extension cables are not provided, so you are responsible for making appropriate charging arrangements.
Damage to Hire Equipment
15. You must take good care of the Hire Equipment and take all precautions necessary to protect it from damage or theft. This includes ensuring the Hire Equipment is locked inside overnight, and that e-bikes are stored in a secure dry environment. You understand that if you leave Hire Equipment outside overnight you will be liable for theft or damage sustained to the Hire Equipment.
16. You are responsible for paying any surcharge incurred for Hire Equipment requiring cleaning or remedial work on return beyond normal post-hire maintenance, calculated and applied at our standard workshop rates.
17. We recommend that Hire Equipment is always kept in sight. Should any loss or damage be sustained to the Hire Equipment during the hire period, such as damage to the frame and decals, you are responsible for payment of the full repair or replacement cost at current market price, for which we will send you a repair estimate by email.
18. If we have reason to believe there may be hidden damage to the Hire Equipment (for example, after an accident), there will be a standard charge of £50.00 to cover the cost of the independent assessment to ensure the Hire Equipment is safe and allowed to continue to be used. Should the bike have sustained any damage, a quote for repair will be submitted to you by email.
19. You may transport the Hire Equipment to another location (i.e., in a van or other suitable vehicle), but you are liable for any damaged caused by such transport. We accept no responsibility nor liability for any damage or accident occurring after a wheel has been removed and refitted by you.
Liability and Indemnity
20. You are responsible for the welfare of all Hire Equipment relating to the Hire Agreement, including that for group bookings, and you are responsible for the payment of any repairs or replacements required for all Hire Equipment under your booking as detailed in the sections above.
21. We strongly recommend you have or obtain adequate insurance cover, as we do not offer any form of insurance to you. It is recommended that you carry personal identification and insurance documents whilst cycling.
22. We do not accept any liability to third parties for damage caused to others or their property, and you are responsible for the payment of any losses incurred by third parties, including those caused by your negligence or incorrect use of the Hire Equipment. You agree to fully indemnify us against claims of losses, injury, or death to any third party unless it can be proven that it was caused by our negligence in the performance of our obligations under the Hire Agreement or to fulfil reasonable maintenance procedures for the Hire Equipment being used.
23. Subject to clause 24, we do not accept any liability for any losses, damage, illness, injury or death suffered by you or any member of your party during the hire period. This includes losses or damage caused by the improper use of the Hire Equipment, by any act or default on your part, or unforeseen circumstances such as ill health.
24. Notwithstanding clause 23, nothing in the Hire Agreement or Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence in the performance of our obligations under the Hire Agreement or for any other matter for which it would be unlawful for us to exclude or restrict liability.
General and Legal
25. Any proceedings, dispute, or claim relating to the Hire Agreement or Terms and Conditions shall be governed by English law. The courts of England and Wales shall have exclusive jurisdiction in respect of the same.
26. In the event that any part of the Hire Agreement is for any reason deemed void or unenforceable, the remainder shall remain in full force and effect.
27. We have the right to revise, change, and modify these Terms and Conditions at any time without prior written notice by posting the revised version on our website.
