BICYCLE HIRE AGREEMENT
Identification and Booking Confirmation
You must bring valid government-issued photo ID (e.g., driving licence, passport) that matches the booking confirmation email.
Hire Agreement
By signing this agreement, you agree to hire the bicycle and accessories specified (the “Equipment”), to pay the cost of hire, and to accept the terms set out in this agreement.
Responsibility for Equipment
You accept full responsibility for the Equipment during the hire period. This includes:
- Safeguarding the Equipment against loss, theft, or damage, regardless of how it occurs.
- Ensuring the Equipment is securely locked to an immovable object when not in use.
- Returning the Equipment by the specified date and time.
Reporting Incidents
You must immediately notify Team Cycles (North East) Limited (“Team Cycles”) of any loss, theft, damage, or accident involving the Equipment. In the case of theft or an accident, you must also report the incident to the nearest police station and provide Team Cycles with a crime reference number or accident report.
Payment
The total cost of hire (the “Payment”) will be collected before the hire period begins. Any additional costs, such as late return fees, replacement or repair costs, or insurance excess payments, may be deducted from your payment card.
Acknowledgment of Risks
You acknowledge that cycling carries inherent risks and confirm that you are a competent cyclist. You must not ride if you are in ill health, have a disability that may affect your ability to cycle safely, or if your eyesight does not meet the standard required for a UK road driving test. You must not ride under the influence of alcohol, strong medication, or other drugs.
Safety Requirements
- It is strongly recommended that you wear a helmet and use appropriate safety equipment and clothing.
- Front and rear lights must be used during hours of reduced visibility.
- You must follow the UK Highway Code at all times.
- You must ride responsibly and avoid any manoeuvres beyond your skill level or the bike’s capabilities.
Liability
You accept full responsibility for any consequences arising from your failure to comply with the terms of this agreement. Team Cycles shall not be liable for any death, injury, loss, or damage resulting from your use of the Equipment, except where such liability cannot be excluded under UK law. Team Cycles’ liability to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, is limited to the total cost of hire.
Indemnity
You agree to indemnify Team Cycles against any liabilities, costs, expenses, damages, or losses arising from:
- Death or injury to any person.
- Damage to any property.
- Any other claims resulting from your hire or use of the Equipment.
Cancellation and Refund Policy
Right to Cancel:
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your booking within 14 days of booking, provided the hire period has not commenced.
Cancellation Before Hire Period Begins:
If you cancel your booking outside of the 14-day cooling-off period but more than 48 hours before the start of the hire period, a cancellation fee of 20% of the total hire cost will apply.
Late Cancellations:
If you cancel within 48 hours of the start of the hire period, the full hire cost will be charged unless due to exceptional circumstances.
No-Show Policy:
If you fail to pick up the Equipment at the agreed time and date, the full hire cost will be charged.
Changes to Booking:
We will do our best to accommodate changes, but any amendments within 48 hours may incur a £10 administrative fee.
No Cancellations or Refunds Due to Weather:
Hire bookings will proceed in all weather conditions. No refunds, credits, or rescheduling will be offered due to adverse weather, including rain, wind, cold, heat, or other conditions. You are responsible for checking forecasts and preparing appropriately.
Exceptional Circumstances:
If Team Cycles cancels your booking due to factors beyond our control (e.g., equipment issues or force majeure events), you will be offered a refund or reschedule. Weather conditions alone do not constitute exceptional circumstances.
Refund Processing:
Refunds will be issued to the original payment method within 7 business days of cancellation approval.
Governing Law
This agreement is governed by the laws of England and Wales. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
