e-Bikes Downings Terms and Conditions
Terms and Conditions:
1. E-bike usage.
2. Deposit and payments.
3. Maintenance.
4. Recovery and road assistance.
5. Responsibility for damage or loss.

7. Personal insurances.
8. Termination of agreement.
If you wish to book a rental e-bike(s) from e-Bikes Downings please read and understand the following Terms and Conditions as they set out our respective rights and obligations.
1. The term "Owner" refers to the company who own and are authorised to rent the e-bikes, namely e-Bikes Downings.
2. The term “Equipment” shall include any equipment rented from or provided by e-Bikes Downings.
3. The term "e-Bike" refers to the electric pedal assist bicycle rented from e-Bikes Downings.
4. The term "Customer" or "Renter" is the renter, payer or authorised user of the e-Bike. This will include all members of a party or group booking associated with the renter.
· We provide high-quality e-bikes for hire. We request that our customers respect the e-bikes and equipment when using them. All customers will be provided with a helmet, high visibility vest and a lock. e-Bikes Downings recommend that the high visibility vest be worn when using the e-bikes.
· The hire period commences on the day the e-bike(s) are collected by the customer and continues until the e-bike(s) and equipment is returned to the designated drop off area or e-Bike Downings’ office.
· e-Bikes Downings require a security deposit on all e-bikes and equipment rented. A security deposit can be taken by cash or credit card authorisation, or by our holding of an official government issued ID document such as a passport or driving licence.
· The renter must be over 16-years of age to order or rent equipment.
1. E-Bike Usage
· The renter agrees that the e-bike(s) rented will only be used by the named individuals.
· The customer will use this e-bike hire service in a reasonable manner. Irresponsible riding will not be accepted.
· All e-bike(s) will be handed over to the customer in good working order.
· Due to the fact the customer is liable for the e-bike(s), the customer is expected to carry out a basic check of the e-bike before taking it e.g. check brakes, handlebars, gears, tyres, frame etc.
· The renter agrees not to misuse the e-bike and return it to e-Bikes Downings in the same condition as it was received. Normal wear and tear is expected.
· Customers must not bring e-bikes onto beaches, or onto land off cycle tracks or roads. If this happens, a cleaning and re-oiling charge of €50.00 will be applied to the customer.
· E-Bikes are forbidden to be ridden on a beach, unpaved or unauthorised roads or those in such condition that they may represent a risk to the e-bike.
· Any goods carried by the customer, either on the e-bikes or on themselves is at the risk of the customer themselves.
· Any injury caused to the customer due to an accident or their mishandling of the e-bike(s) is at the risk of the customer. Any damage caused to the clothing or accessories of the customer whilst not the e-bike is also at the risk of the customer.
· E-Bike(s) should not be used by persons under the influence of alcohol, narcotics, other toxic substances or any other substances (whether legal or illegal), that directly or indirectly reduce their ability to ride the e-bike safely. e-Bikes Downings take no responsibility for customers’ actions under the influence of any of the above or any other such substance.
· It is forbidden to carry passengers in a number exceeding that authorised or for transporting children without authorisation from e-Bikes Downings.
· It is forbidden to carry or transport live animals or pets unless it was authorised in advance by e-Bikes Downings.
· The Renter(s) agrees to lock the e-bike(s) when they are not in use or parking them in order to protect and safeguard the e-bikes at all times from theft or loss.
· The Renter(s) agrees to respect the Road Safety Authority’s “Rules of the Road” and pedestrians right of way. For further information on the RSA’s Rules for Cyclists log on to the RSA website: https://www.rsa.ie/services/learner-drivers/resources/rules-of-the-road Section 17: Rules for Cyclists pages 195-204. Any ticket or fine due to incorrect use of the bicycle will be the responsibility of the customer.
· In the event of an e-bike(s) not being returned to e-Bikes Downings, the matter will be treated as a stolen e-bike(s), and matter will be passed onto the Garda Síochána.
· An e-bike reported stolen by the renter, must be reported to An Garda Síochána. The renter will remain fully responsible for that e-bike(s) until a report is produced from the Garda Síochána stating the e-bike has been reported stolen. The customer must take all precautions to ensure the e-bike(s) is not stolen e.g. locking the e-bike(s). Working locks will be given with each e-bike(s) rental at no extra cost.
· The size and weight restriction is a guide only for e-bike(s), and we do not accept responsibility for a wrongly chosen e-bike size. However, we will do our very best to rectify the problem and supply the customer with a correctly sized e-bike.
· You will not hold e-Bikes Downings responsible for any loss, damage or injury including death to persons or property with regard to the use of the e-bike(s) and equipment hired. You accept responsibility to Indemnify e-Bikes Downings against any claim, interest, demand or expense in respect of such injury or damage. It is the customer's responsibility for their own safety. Cycling involves personal risk and you must ride responsibly.
· Our e-bikes may not be driven outside a radius of 30km from the location where the rental was collected. The e-bike cannot be used in sporting events or off-road. The e-bike must be driven exclusively by the renter or an authorised additional driver.
· We strongly recommend the use of approved helmets whenever mounted on a e-bike(s). Helmets and high visibility vests are provided at no extra cost. The e-bike(s) provided for use are in good working order and operating condition and participants agree to use them at their own risk or call deficiencies to the attention of a company representative. Instruction in the use of e-bike(s) will be provided and participants affirm that they are familiar with the use of a multi-speed e-bikes.
· Renters of the e-bikes cannot be under 16 years of age.
Health and Fitness Requirements
Customers should be healthy and active. It is vital that persons with medical problems make them known to Downings e-Bikes before the rental period commences. e-Bikes Downings assumes no responsibility regarding the provision of medical care.
2. Booking Information and Conditions
· The renter agrees to pay e-Bikes Downings the cost of rental for the agreed time period. The price will include all taxes and fees.
· e-Bikes Downings may further charge the renter for the services the former is required to perform due to incidents that may have occurred during the rental period and/or owed as a result of the manner in which the Renter has used the e-bike or equipment.
· The value of those services or expenses is listed in the costs schedule, which is available upon collection of the e-bike. Such services and expenses include, without limitation:
· The value of damage and/or theft to which the e-bike or equipment is subject, in whole or in part, dependant on the particular circumstance.
· The amount to be charged to the renter for the damage to the e-bike or equipment or replacement if stolen shall be calculated according to the respective e-bike/parts price list, which is available to the renter to view at www.lkbikes.com plus labour. In any case, the maximum liability of the renter in this situation shall not exceed the value of the e-bike, as indicated on the www.lkbikes.com website plus labour.
· The amount corresponding to any pecuniary charges in the event of any violation of applicable law, in particular the Road Safety Authority’s “Rules of the Road”, committed by the Renter, as well as expenses resulting from any delays in payments and also such legal and extrajudicial expenses as are incurred by e-Bikes Downings as a result of that mentioned above.
Payment Method
· Payment by the Renter to e-Bikes Downings of the amounts indicated above shall be made by means of a Credit Card or Debit Card or cash.
· e-Bikes Downings require a security deposit on all e-bikes and equipment rented. A security deposit can be taken by cash or credit card authorisation, or by our holding of an official government issued ID document such as a passport or driving licence.
· We require a damage deposit/security in the form of:
1. Driver’s license
2. Passport
3. Photo ID of the Renter, or one member of the party if it is a group booking.
Your deposit document will be securely held by e-Bikes Downings. Any deposit given by the customer shall be applied to and guarantee the faithful performance of all the provisions of this agreement and all replacement e-bikes if stolen or repairs necessary to said equipment. If any action is brought to enforce any of the terms of conditions of this agreement or to recover any sums due to hereunder, the customer agrees to pay all legal fees, court costs, or other expenses.
Refunds and Cancellations
· All cancellations have to be made in writing and sent by email to info@downingse-bikes.ie
· Cancellation assessments will be calculated on the day e-Bikes Downings receives your notification. The following policy will apply:
1. Bookings that are cancelled more than 30 days before the rental commences are fully refundable.
2. Fee of 100.0% (No Refund) if booking cancelled 72 Hours before the rental commences.
3. Fee of 50% (50% Refund or Credit) if booking cancelled 7 day(s) before the rental commences.
4. Fee of 0% (Full Refund or Credit) if booking cancelled 14 day(s) before the rental commences.
· e-Bikes Downings reserve the right to cancel a booking at any time, a full refund will be given to the customer under these circumstances.
· e-Bikes Downings will offer an alternative booking or Credit in the event of a national red weather warning.
Late Return Fees
· All e-bikes and equipment must be returned directly to its original location, designated drop off point or wherever agreed. We allow a 30-minute late return grace period from your established return time. Delays beyond the grace period will be charged at €20 per hour or a fraction of an hour.
3. Maintenance
· All our e-bikes are serviced and maintained, however e-bike(s) may need tuning or maintenance during the course of the rental period. e-Bikes Downings are not responsible for the following occurrences during an e-bike(s) rental:
1. Punctures
2. Broken spokes
3. Broken chains or broken derailleurs
4. Wheel rim damage
5. Gear tune-ups
6. Or damage beyond the control of e-Bikes Downings.
· Each e-bike is provided with a fully charged inspected battery pack. The range of the available charge is dependent on a series of variables including, distance traveled, the difficulty of road or path incline, passenger weight, power level usage. The battery should provide sufficient charge to assist the e-bike between 45km and 70km. The Renter will be responsible to ensure that they return the e-bike to its original location.
4. Recovery and Road Assistance
· e-Bikes Downings will provide roadside recovery in the event of a breakdown, technical or mechanical failure or incident whereby the renter is unable to utilise the e-bike and return it to its original location.
5. Responsibility for Damage or Loss
· Customer agrees they will return the e-bike(s) and equipment in the same good condition as when received, ordinary wear and tear accepted, and to repair and replace lost or stolen, damaged or broken e-bike or parts or to reimburse e-Bikes Downings for said equipment.
· Stolen or damaged equipment will be charged for at full replacement cost as per the LK Bikes website www.lkbikes.com plus labour. Therefore, regardless of the party at fault, the customer understands and agrees to be responsible for the theft or damage to said e-bike(s) or equipment. The Renter shall assume liability for any and all damage or loss to personal property, accident or injury to other persons related to said rental e-bike(s) or equipment.
6. Subleasing Prohibited
· The customer understands and agrees that any sub-leasing or sale of rental e-bikes or equipment is prohibited and that any such sub-lease shall immediately cause termination and cancellation of this contract.
7. Personal Insurances
· e-Bikes Downings does not provide a personal accident insurance policy to use their e-bike(s) and the customer does so entirely at their own risk. We strongly recommend that you take out your own personal liability or travel insurance policy.
8. Termination of Agreement
· The customer agrees that e-Bikes Downings have the right to terminate this agreement at any time and retake possession of said equipment.
These Conditions of Use are subject to Irish Law. Any dispute arising from the performance and consequences, therefore, shall be brought before the Courts of Ireland to which the Parties expressly attribute jurisdiction, including in the event of Summary Judgements, the introduction of Third Parties or numerous Defendants.
