TERMS & CONDITIONS + LIABILITY WAIVER – DISCOVER BIKES CYCLE HIRE
Dear Customer,
Thank you for choosing to rent a bike from our company. Before proceeding with your bike rental, we would like to bring to your attention the following Waiver and Terms & Conditions:
1. Proof of identification and order reference must be provided upon collection of your equipment. This can be a Drivers Licence, Passport or other form of valid Identification. This will be taken as part of the deposit and locked in the till, it will be returned to you once all equipment hired has been returned.
2. A damage deposit may be required for group bookings over 1 unit and will take the form of a pre-authorisation debit/credit card transaction, through our on-site terminal or online payment gateway. This will be surrendered upon return of all equipment in a satisfactory condition. Should there be damage to the bicycle, the cost of repair will be taken from the card you have paid on and authorised as the pre-authorised deposit card. Upon late return, any balance will be paid in full via the same means.
3. As the client, you must agree responsibility for all equipment relating to this hire agreement, this will be listed on your order confirmation and is available to the member of staff on duty so they can either show or print off for your records. You confirm that you will be responsible for the payment of any damage (including third party) caused as a consequence of any negligence, loss of control, dangerous behaviour or loss of equipment due to the cycles not being locked to a fixed object through the frame and front wheel. Proof of lock breakage is required for any insurance claim and you will be charged should this not be provided.
4. You confirm you are ALL competent cyclists and recognise you will be riding cycles which you may not be familiar with and as such you ALL will exercise additional care and attention. DISCOVER BIKES lends cycles on the understanding that ALL riders can operate gears properly, adjust the saddle height, can put a chain back on, can check the quick release wheel skewers are tight and at least one person knows how to FIX A PUNCTURE or replace a tube.
5. I understand that refunds are only given PER BICYCLE (not for the whole group) and only if DISCOVER BIKES are found to be at fault for the failure of equipment. Refunds CANNOT AND WILL NOT BE GIVEN for punctured tyres or damage caused as a result of incorrect use. You accept responsibility for bike damage caused by incorrect/ negligent use of equipment and that the nature of off-road cycling makes these dangers very possible.
6. I confirm that I will be responsible for the payment of any surcharge incurred as a result of the cycles being returned: A. later than the agreed time stated. B. Requiring remedial work beyond DISCOVER BIKES normal post-hire maintenance. C. The loss of any equipment provided at the start of the hire session.
7. I understand that bikes not returned to the place of hire (Discover Bikes, Performance Cycles GL7 5LW) which require collection will be charged for collection by our delivery team. A £50 charge for collection within 10 mile radius of GL7 5LW or £100 charge for collection over 10 mile radius from GL7 5LW.
8. I fully indemnify DISCOVER BIKES against claims of injury to myself or any third party unless it can be proven that DISCOVER BIKES did not fulfil reasonable maintenance procedures for the equipment being used.
9. You must acknowledge the STRONG recommendation of DISCOVER BIKES to use safety helmets whenever the bicycle on hire is being ridden. By choosing not to, you and everyone else in your group assume FULL RESPONSIBILITY for any accident, injury or death which should occur as a result of taking this decision. Helmets are provided free of charge with each bike hired from Discover Bikes so we urge customers to make the most of this and wear them during their time on the bike.
10. All young persons (aged 16 or younger) MUST under any circumstance wear a cycle helmet as a condition of hire, and will only be issued with equipment when accompanied by a parent or guardian.
11. Safe cycling is heavily dependent on your good judgement and level of alertness. Please ensure you always cycle sensibly, with respect for others and the natural habitat you are passing. Key examples of when to take extra care are: Crossing roads, riding toward any obstruction in our chosen path, using a heightened awareness of your surroundings when cycling on a road shared with motorists. Cyclists are expected to follow the Highway Code and Cotswolds Cycling Code so ensure you are aware of this prior to riding the bicycle/s on hire.
12. Cycling can be dangerous and has risks involved. When a sensible approach is not taken, death and serious injury is a very real possibility. By signing this ‘Hire Agreement & Liability Waiver’ you and everyone else in your group declare to be in good health and are not suffering from any medical condition or disability which is likely to adversely affect normal control of the bicycle. You and everyone else in your group also agree to: A. Not undertake any manoeuvres which are beyond your level of skill or beyond the design purposes of the equipment provided by DISCOVER BIKES. B. Not ride on pavements or footpaths and keep to the Official Cycle Byways. A £500 fine may be levied against you by officers of the Forestry Commission for damage caused to land or livestock off of the permitted cycle network. Please note: the WHOLE of the Cotswolds has AONB status and a vast majority of land is privately owned.
13. I understand that in the event of a mechanical failure other than punctures, DISCOVER BIKES will offer a breakdown service for the cycle but not the individual (due to insurance constraints). The emergency number is 01285 851946.
14. This Agreement is covered by English Law. In the event that any part of the Agreement is for any reason unenforceable the remainder shall remain in full force and effect. The Hirer is Discover Bikes at Performance Cycles. Company Number 06889748.
CANCELLATION POLICY:
We at Discover Bikes strive to provide our customers with exceptional service and flexibility when it comes to booking our bikes. We understand that plans may change, and we want to ensure a hassle-free experience for all. Therefore, we have implemented a 48-hour cancellation policy, outlined below, to address any cancellation or rescheduling needs:
1. Cancellation Period: Customers have the right to cancel their bike rental reservation up to 48 hours (This increases to 7 days for groups of 5 people or more) within the scheduled pick-up time without incurring any cancellation fees.
2. Cancellation Notification: To initiate a cancellation, customers must notify Discover Bikes by phone, email, or through our online booking system. It is important to provide your reservation details, including the reservation number, customer name, and the date and time of the original booking.
3. Cancellation Charges: Any cancellation within 48 hours (7 days for groups of 5 or more) of the pick-up time will be charged the full amount of the hire.
4. Refund Process: Upon cancellation within the specified period, Discover Bikes will refund the full amount paid by the customer for the bike rental. The refund will be processed using the original payment method within a reasonable timeframe.
5. No-shows: If a customer fails to cancel their reservation and does not show up to collect the bike within the scheduled pick-up time, the full rental fee will be charged.
6. Modification and Rescheduling: Customers who wish to modify or reschedule their bike rental booking may do so without penalty, provided they inform Discover Bikes at least 48 hours (1 week for groups of 5 or more) before the original pick-up time. Changes made within 48 hours of the original pick-up time may be subject to availability and additional charges.
7. Force Majeure: In the event of unforeseen circumstances, such as EXTREME weather conditions or other force majeure events, that prevent the customer from using the bike rental service, Discover Bikes will work with the customer to find a suitable resolution, which may include rescheduling or refunding the rental fee.
By signing, I acknowledge that I have read and fully understand this waiver and release of liability and voluntarily sign it as my own free act and deed.
