Adventure Ready Ireland Limited

trading as West Ireland Cycling (“WIC”)

and Green Marble Tours (“GMT”)

THESE CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.

Participation in a cycling holiday or bike hire is subject to the acceptance by the participants to the following terms and conditions:

· Adventure Ready Ireland Limited t/a WIC & GMT will provide all participants with bicycles, helmets & equipment that will be delivered in perfect working condition and these must be returned in the same condition at the end of the tour, allowing for normal wear and tear.

· Adventure Ready Ireland Limited t/a WIC & GMT takes reasonable care to ensure that all equipment is maintained to a high standard and that our tours are planned with your safety in mind. However, participation remains at your own risk.

· Participants understand and accept that they take part in cycling activities at their own risk. To the fullest extent permitted by law, Adventure Ready Ireland Limited t/a WIC & GMT shall not be liable for any injury, loss, damage, or expenses incurred by participants during the tour or hire, except where caused by negligence on the part of Adventure Ready Ireland Limited t/a WIC & GMT.

· In particular (but not limited to) clients declare that:

o They are able to ride a bike safely;

o They are of good health and will disclose any medical conditions that may affect their ability to participate.

o They know the Irish Rules of the Road;

o They are able and willing to follow all of the instructions given by staff.

o They are not under the influence of alcohol or any other substances which may impair their judgement or coordination.

o They understand fully how to use all of the equipment that has been given to them by Adventure Ready Ireland Limited t/a WIC & GMT and agree to use it.

· Participants agree to indemnify and hold harmless Adventure Ready Ireland Limited t/a WIC & GMT, its directors, employees, and agents from and against any and all claims, demands, actions, proceedings, liabilities, damages, losses, costs or expenses (including legal fees) arising out of or in connection with any injury or damage caused to any third party (including but not limited to pedestrians, road users, or property owners) as a result of the participant’s acts, omissions, or breach of these terms and conditions. This indemnity shall not apply where such injury or damage arises as a result of the negligence of Adventure Ready Ireland Limited t/a WIC & GMT.

· The maximum liability of Adventure Ready Ireland Limited t/a WIC & GMT, in any case, shall not exceed the amount paid by the participant for the tour or hire in question.

· Participants of the cycling tour or bike hire are required to practice prudence and diligence, particularly in relation to the use of the equipment provided by Adventure Ready Ireland Limited t/a WIC & GMT.

· Participants accept that the use of equipment provided by Adventure Ready Ireland Limited t/a WIC & GMT is at their own risk.

· Participants of the cycling tour or bike hire have the right to purchase personal insurance to cover potential damage to their person, third parties or equipment.

· Adventure Ready Ireland Limited t/a WIC & GMT accepts no liability for any damage to the participant, third parties and equipment however caused during tours or bike hire.

· Adventure Ready Ireland Limited t/a WIC & GMT does not accept any liability for loss of baggage, money, valuables or any other items during the tour.

· Participants of the cycling tour or bike hire agree not to exceed the maximum total weight limits of 125kg/275lbs per bike.

· Participants of the cycling tour or bike hire will be held liable for all damages that Adventure Ready Ireland Limited t/a WIC & GMT may endure due to the failure of the participant to comply with their obligations.

· We may use your name in a WhatsApp group to coordinate logistics during your cycling tour or rental. By signing these terms, you give your explicit consent for us to use your name for this purpose. You may withdraw your consent at any time by notifying us.

· These terms and conditions shall be governed by and construed in accordance with the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
