Bicycle Rental Terms and Conditions

Acceptance of full liability for damage to rented item/items

I understand that upon return of the rented bicycle, helmet and protective gear  Bro Bike Limited will inspect it for damage. Unless insurance has been sold to the customer via Bro Bike Limited I take full liability for anything other than damage to the following consumable items:

Tyres

Handlebar Grips 

Brake Pads

Any damage no matter how minor will be charged out at full RRP of the part/parts damaged plus installation at a workshop labour rate of $80 per/hour. Bro Bike Limited reserves the right to levee additional fee(s) on my final bill to cover damages. 

Insurance

Insurance must be purchased at the time of payment before the rented equipment leaves the shop and can not be added after the rental has begun.

Insurance covers all damage that occurs during the rental period but does not cover the total loss of the bike/bikes and/or rented items. I.e if you do not return the rented items to the shop you will be liable for the full RRP of the item/items lost.

Rental Bike Cancellation Policy 

Weather: Bikes are waterproof (ish) and we have many fond memories of riding in the rain so we encourage riding during all types of weather. That being said we do offer a full refund if the gondola closes for heavy rain. This is only for our full suspension mtb customers. 

Up until 48 hours prior to the date and time of pickup the Customer may change or even totally cancel the booking with a full refund.

Within 48 hours prior to the booking no refunds will be given. (this is due to the commitment Bro Bike Ltd have made which prevents other individuals or groups from taking your reserved equipment. If the customer does not honour their commitment to the booking Bro Bike Ltd would loose out financially, therefore we have adopted the policy above to prevent this).

Bicycle Rental Waiver and Release of Liability 

Assumption of Risk:

I understand and accept that renting this bicycle and participating in biking exposes me to many hazards and entails unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I also understand I should be in good physical health to participate in bicycling. I choose to participate in bicycling in spite of these risks and hereby assume all risk of injury or loss of life to myself and loss of or damage to property arising out of renting this bicycle and participating in bicycling. I understand the inherent risk involved in using this equipment; accept full responsibility for any and all such damage or injury which may result. Waiver and Release: In consideration of Bro Bike Limited renting me this bicycle, I specifically release and forever discharge Bro Bike Limited and its officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which I may suffer while renting this bicycle and participating in bicycling. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence of Bro Bike Limited or its officers , agents, or employees. It is my intent by the Waiver and Release Agreement to release Bro Bike Limited and hold it harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by the negligence of Bro Bike Limited or whether based upon breach of contract, breach of warranty, or any other legal theory. In signing this document, I fully recognise that if injury, illness, death or damage occurs to me while I am engaged in renting this bicycle or participating in bicycling, I will have no right to make a claim or file a lawsuit against Bro Bike Limited or its officers, agents or employees, even if they or any of them negligently cause my injury, illness, death or damage. 

• I hereby commit to wearing a helmet at all times while riding the bicycle.

• I understand that this activity may result in severe injury, including but not limited to spinal or head injury. 

• I understand that accessories such as child seats and trailers can change the dynamics of cycling and can create additional risks for the cyclist and the rider or passenger.

• I understand that this activity may result in hazards posed by other bicycles and traffic or road conditions.

• I understand how to operate the rental bicycle’s gears and brakes and adjust the seat and quick releases.

• I understand that this bicycle does not have lights and that I will not ride when dusk or dark.
