Terms and Conditions for Bicycle Hire

Welcome to NF Bikes Lymington. By hiring a bicycle from us, you agree to the following terms and conditions. Please read these carefully.

1.       Rental Agreement

·         The hirer must present valid identification upon collection of the equipment. There can be no exceptions. Acceptable ID includes passport, driving licence or official ID cards.

·         The duration of the hire period will be agreed upon at the time booking. Extensions can be requested and must be approved by the NF Bikes Lymington shop.

 

2.       Payment and Deposit

·         Full payment for the hire must be made in advance.

·         A refundable deposit of £xxx per bicycle is required to cover potential damage or late returns. The deposit will be refunded upon the safe return of the bicycle on time and in the same condition as it was hired.

 

3.       Capability and Competency

·         The hirer confirms that ALL members of the group are competent cyclists, are familiar with the UK Highway Code and meet the minimum legal age (14 yrs) for e-bike hire.

·         The hirer recognises that they will be riding bicycles which they may not be familiar with and as such will exercise additional care and attention. NF Bikes Lymington lends bicycles on the understanding that every rider can use gears properly, adjust the saddle height and at least one person knows how to fix a puncture.

 

4.       Safety

·         Cycling can be dangerous and has risks involved. By signing this Agreement, the hirer and everyone else in their group declare to be in good health and are not suffering from any medical condition or disability which is likely to adversely affect normal control of the bicycle.

·         The hirer is responsible for the care and safe use of the bicycle during the hire period and agrees to:

         not undertake any manoeuvres which are beyond their level of skill or beyond the design purposes of the equipment provided by NF Bikes Lymington.

         not ride on pavements or footpaths and keep to the Official Cycle Network within the National Park. A £500 fine may be levied against you by officers of the Forestry Commission for damage caused to land or livestock off of the permitted cycle network. Please note the whole of the New Forest has SSSI status.

         not cycle after dark as unless the bicycles are fitted with lights, bells and reflectors.

         not to use the bicycle for illegal purposes or in a reckless manner.

·         NF Bikes Lymington strongly recommends the use of safety helmets and supplies them free of charge. By choosing not to wear helmets and by signing the disclaimer as part of the waiver, the hirer assumes full responsibility for any accident, injury or death which should occur to any member of the group as a result of taking this decision.

·         All young persons (aged 17 or younger) MUST wear a cycle helmet as a condition of hire, and will only be issued with equipment when accompanied by a parent or guardian.

 

 

 

 

5.       Security

·         Any damage theft, or loss of the bicycle during the hire period is the hirer’s responsibility. Charges for repair or replacement will be deducted from the deposit or an additional surcharge will be applied if the loss is greater than the value of the deposit.

·         Bicycle theft is unfortunately common in the United Kingdom and NF Bikes Lymington strongly recommends that you stay with the bicycles and never leave them unattended. If the hirer stops for any reason, they should ensure they are locked within their sight using the free heavy-duty lock provided by NF Bikes Lymington.

·         NF Bikes Lymington offers insurance to protect the hirer from total replacement costs in the event of a loss. If, however, the bicycles are not locked to a fixed object through the frame and front wheel or are beyond line of sight the insurance will be negated as proof of lock breakage will be required for any insurance claim.

 

6.       Breakdowns

·         In the event of a mechanical failure other than punctures the hirer should seek guidance from NF Bikes Lymington immediately through the emergency number on the front of the Hire Agreement

·         If the failure is unable to be repaired remotely, NF Bikes Lymington will offer a breakdown service for the bicycle including if necessary reasonable/pre agreed travel costs.

·         NF Bikes Lymington will not be liable for accidents or injuries resulting from improper attempts the repair bicycles or failure to report issues promptly.

 

7.       Returns

·         The bicycle must be returned on or before the agreed return time and date.

·         Late returns will incur an additional fee of £[amount] per hour/day.

 

8.       Responsibility and Liability

·         The shop is not responsible for personal injury, loss, or damage to personal belongings during the hire period.

·         The hirer acknowledges that cycling involves risks and agrees to assume full responsibility for their actions. The hirer confirms that they will be responsible for the payment of any damage (including third party) caused as a consequence of any dangerous cycling, loss of control or negligence.

·         The hirer acknowledges that they will be responsible for the payment of any surcharge levied as a result of the bicycles being returned later than the agreed time, in an excessively dirty state or requiring remedial work beyond NF Bikes Lymington’s normal post-hire maintenance.

·         The hirer fully indemnifies NF Bike Lymington against claims of injury to themselves or any third party unless it can be proven that NF Bikes Lymington did not fulfil reasonable maintenance procedures for the equipment being used.

 

9.       Cancellations and Refunds

·         Cancellations made 7 days prior to the booking start time are eligible for a full refund.

·         Cancellations between 2 and 6 days are eligible for a 50% refund.

·         No refunds will be issued for cancellations made within 48 hours or after the hire period begins.

·         Cancellations will only be accepted through direct emails to info@nf-bikes.co.uk

 

10.   Data Protection

·         Personal information provided by the hirer will be used solely for the purpose of the hire agreement or direct marketing by NF Bikes Lymington if opted in and will not be shared with third parties.

 

11.   Legal Jurisdiction

·         These terms and conditions are governed by the laws of England
