Garda Bike Hub S.R.L., with registered office in Via Bell’Italia 35, Peschiera del Garda (VR), VAT No. 04794700239, represented by its legal representative pro tempore (hereinafter referred to as the “Provider”).
1.1 Garda South Cycling undertakes, in return for payment, to provide the Customer with a bicycle in perfect working condition and excellent general condition.
1.2 By signing this agreement, the Customer declares:
1.2.1 To assume the obligation of payment;
1.2.2 To have inspected the bicycle upon delivery;
1.2.3 To have received the bicycle in good operational condition.
1.3 Any defects must be reported to staff immediately.
2.1 The Customer is required to present:
2.1.1 A valid identity document for each user;
2.1.2 A credit card for a security deposit (equal to 50% of the bicycle’s value).
2.2 The Customer declares to have sufficient technical skills and physical fitness to use the bicycle.
2.3 The use of lights and high-visibility vests is mandatory under applicable traffic laws (Art. 182 Italian Highway Code).
2.4 The use of a helmet is strongly recommended, even for adult users.
2.5 The Customer is responsible for the bicycle until it is returned, including any damage to themselves, the bicycle, or third parties.
2.6 In case of theft, loss, or damage:
2.6.1 The Customer will reimburse the Provider for the full value of the bicycle if it is not recovered;
2.6.2 The Customer will cover the repair cost in case of damage;
2.6.3 The Customer will be liable for damage to any accessories (helmets, child seats, trailers, bags, etc.).
2.7 In case of theft or loss, a police report must be filed, and a copy must be delivered to the Provider.
2.8 The bicycle must be used with caution and responsibility.
2.9 The bicycle must be stored in a safe place during both day and night.
2.10 It is strictly forbidden to transport the bicycles on unauthorized or unsuitable private vehicles. Any resulting damage is the responsibility of the Customer.
2.11 Any anomaly must be immediately reported to staff.
2.12 Failure to return the bicycle within the agreed time will be considered unlawful appropriation and reported to the authorities.
2.13 The Customer is responsible for use by third parties, even if not indicated in the agreement.
2.14 In the case of multi-day tours, the Customer agrees to store the bicycle in a secure location, preferably at the lodging facility.
2.15 The Provider declines all liability for damage or accidents occurring during use or guided tours.
2.16 The Customer accepts the inherent risks associated with outdoor excursions.
2.17 The bicycle must be returned to the original rental location, or to another location previously agreed with the Provider, even in the case of malfunction or damage.
2.18 The Provider is not liable for service disruptions due to exceptional events or force majeure (e.g. weather conditions, unexpected mechanical failures, route restrictions).
2.19 In the case of electric bicycles (e-bikes), the Customer must use the lock provided and store the battery safely. If the battery is stolen due to improper storage, the full replacement cost will be charged.
3.1 The bicycle may only be used for recreational, tourist, or occasional purposes.
3.2 Subleasing, reselling, lending, or transferring the bicycle to others is prohibited.
3.3 Tampering with the speed limiter on pedal-assist e-bikes is strictly forbidden.
3.4 The bicycle must not be left unattended.
4.1 The Provider reserves the right to check the condition and use of the bicycle at any time.
4.2 The bicycle must be returned at the agreed location and time. Any deviation must be approved in advance and may result in extra fees.
4.3 During guided tours, the Customer agrees:
4.3.1 To follow the guide’s instructions;
4.3.2 To ride responsibly and safely;
4.4 To comply with the Italian Highway Code.
4.5 The Customer releases Garda South Cycling from any liability for damage to themselves or third parties. The bicycles are not covered by liability insurance.
4.6 The Provider is not responsible for improper use or violations of traffic regulations.
4.7 Full payment is required at booking or upon collection of the bicycle.
4.8 If the Customer violates the agreement or fails to pay, the Provider may immediately request return of the bicycle.
4.9 A late return fee of €30/hour will apply if the bicycle is returned after the agreed time.
5.1 Reservations are only valid if made through:
5.1.1 The official website www.gardasouthcycling.com, at least 24 hours in advance;
5.1.2 In-store, via check-in on tablet or QR code.
5.1.3 Bookings via phone, email, or other channels are not accepted.
6.1 Cancellations are accepted under the following terms:
6.1.1 Up to 72 hours before: €5 cancellation fee;
6.1.2 Between 72 and 48 hours: 50% of rental cost will be charged;
6.1.3 Less than 48 hours: 100% of the amount will be charged.
6.1.4 Booking changes are allowed with a €5 fee per modification.
6.2 The Provider may cancel the booking in case of force majeure, issuing a full refund.
6.3 For rentals combined with transfer services, delays of more than 15 minutes may result in cancellation without refund.
Garda South Cycling is not liable for malfunctions or mechanical issues caused by the bicycles, as it is not the manufacturer. In case of verified non-usable bicycles, the Provider may issue a voucher or apply a discount for future use.
The recovery service (“roadside assistance”) is available for an extra fee and must be requested at the time of booking. Later requests are subject to availability and additional charges. Recovery is only available on accessible roads.
9.1 According to Italian Legislative Decree 196/2003, all collected personal data will be processed lawfully and transparently.
9.2 The data controller is Garda Bike Hub S.R.L.
9.3 Data will be used for:
9.3.1 Contractual purposes;
9.3.2 Promotional communications;
9.3.3 Legal compliance and authority requests (e.g. traffic violations).
9.4 The Customer may exercise their rights as provided by Article 7 of Legislative Decree 196/2003.
For any legal dispute concerning the interpretation or execution of this agreement, the Court of Verona shall have exclusive jurisdiction.
In accordance with Articles 1341 and 1342 of the Italian Civil Code, the Customer declares to have read, understood, and accepted all the clauses contained in sections 1 to 10 of this agreement.
