Danger Zone srl
General Delivery and Rental Conditions:
The MTBs are delivered in optimal conditions, and a check up of the vehicle is carried out upon delivery and re-delivery. Any damages will be charged or in the case of insurance the cost of the deductible will be charged. In
the absence of insurance, in the event of a puncture you are required
to reimburse € 5.00 as reimbursement of costs for replacing the inner
tube + the cost of the inner tube (variable according to the size,
brand, etc...). Subscribing
to the insurance guarantees coverage for the amount of one puncture per
day, in the event of more punctures/day, those subsequent to the first
will be reimbursed as previously described.
Upon delivery of the bike, the renter must:
- Sign the
assumption of responsibility for the use of the vehicle and/or
equipment and provide a suitable identification document; if the
customer is under the age of 18, a suitable identification document of
the parent or guardian must also be provided; The document will be returned upon return of the vehicle and/or equipment.
During the rental period, the renter is responsible for:
- make proper use of the bicycle; do not entrust the use of the bicycle to others;
- respect road signs, pedestrian traffic and other means of transport and the rules of the C.d. Road, and the regulation of the Bike Park or DPB areas
- keep your MTB and equipment under your own responsibility
The renter assumes no responsibility for damage caused by the renter with the rented vehicle to things or people.
Damages:
In the
case of insurance, for accidental and negligent (non-malicious) damages,
a deductible of 20 euros is applied (variable value based on the type
of Kasko subscribed). In
the event of no insurance coverage, the damage is charged by applying
the cost of restoring the damage, including labor costs.

The
undersigned also DECLARES and acknowledges for me and for each of my own
possible assignees or rights, the following towards Danger Zone srl,
based in Andalo (TN), via Priori 14, as charterer
to have
read the regulations, limits, prohibitions and to unconditionally
accept, as well as to know all the sporting rules for the use of the
equipment, and to know the rules and regulations of the road-tracks or
other that he intends to travel;
to be in perfect physical and mental health and that one's vision (also with the aid of corrective lenses) is adequate;
to want to use the equipment exclusively where permitted by laws, regulations, and to assume responsibility for use;
to
exonerate the charterer from any liability in the broadest way for
himself and for his successors and assigns in any capacity from any and
all obligation to pay compensation of any kind or title to compensation
for damages, indemnities, refunds, etc. in
the event of any accident, whatever its duration, its outcome and the
relative consequences that could occur to the undersigned, or to any
passenger/third party, on the occasion of the rental that he intends to
carry out and whatever the cause of the accident may be injury to anyone attributable, including the charterer, his supervisors, collaborators and any other component involved;
to exempt
the charterer from any liability in the broadest way for himself and for
his successors and assigns in any capacity from claims that could be
advanced in any capacity by third parties, including any passenger, as a
consequence of the use by the undersigned of the rented equipment;
to assume
in this regard all the more complete responsibility for any accidents
and consequent direct or indirect damages deriving therefrom to the
structures present, to himself, to third parties, to third party goods
and means, whether they are spectators, members of the organization or whoever
else you want, undertaking to pay the related compensation, relieving
now and then the charterer from any and all liability in this regard, as
well as holding the same harmless from any claim for damages that
should be addressed to the same by third parties for the reasons
referred to above; the drivers of other vehicles are also included among these third parties;
to
undertake to compensate Danger Zone srl for all damages caused to
plants, structures and people as well as to indemnify Danger Zone srl
and/or other companies for all expenses and charges that they have to
incur for any reason in my interest;
to have
personally ascertained the state of the rented vehicles and to have
considered them in perfect condition and suitable for use;
to
undertake, assuming in this regard any and all civil and criminal
liability towards third parties or assignees, not to grant the
authorization nor to the use of the equipment to any other person;
to be
aware that the organizer does not have any insurance policy to guarantee
damages and injuries that I may suffer in the use of the equipment, due
to third parties and other users, nor for my civil liability for
damages that I may cause to third parties and other users;
to be
aware of the fact that the renter has accepted my registration only due
to the fact that the undersigned has exonerated him from liability by
renouncing any legal action for compensation and that, failing that, the
registration would not have been accepted;
to be
aware that Danger Zone srl should the renter infringe the established
rules, or the legislation governing the use of systems and structures,
or in the event that their behavior could be clearly dangerous, the use
of the means and in this case the payment/s made to Danger Zone srl will not be refundable, not even partially;
to consent
that my name, all photographs, video clips or any other representation
of me made by Danger Zone srl or its representatives in connection with
my participation in this event, as well as any reproduction or
replication thereof, may be used by Danger Zone srl or its representatives in any way, as long as it is reasonable, without my further approval;
to have read the rules of use, attached hereto, and to be fully aware of them, as well as to adapt to them
for any controversy to accept as of now the exclusive jurisdiction of the Court of Trento (TN)
The
undersigned expressly confirms all of the above for any legal effect and
waives the right to take any legal and/or out-of-court action against
Danger Zone srl and/or its representatives and/or collaborators for any
damage occurring to their person or vehicle ,
including death, during the rental, and declares to consent to the
indemnity in favor of the aforementioned subjects in the event that
someone else undertakes a legal and/or extrajudicial action against them
in the specific case that the costs or losses in question are directly
or indirectly attributable to the rental of the equipment.
I, the
undersigned, expressly confirm all of the above to any effect of the
law, I am aware that, through this document, I assign a substantial part
of my rights. I
declare and confirm that I have read and understood what is written in
the document, the legal implications and all the consequences, before
signing at the bottom of the same.
They are specifically approved pursuant to articles 1341 and 1342 of the Italian Civil Code the above disclaimer clauses, specifically articles a,b,c,d,e,f,g,h,i,l,m,n,o,p.
The
personal data declared above and those that will be provided later, may
be used for sending communications, information or advertising material
in general, for promotions or opinion polls. In
compliance with Legislative Decree 196/2003 on the subject of
"protection of personal data", the data released are intended as
confidential. At
any time I will be able to have them modified, updated or canceled free
of charge by addressing the Danger Zone srl communication
Dear Customer,
in order to guarantee the service, we invite you to scrupulously respect the delivery time of the
rented material according to the indications that our staff communicates to you upon delivery.
In case of non-compliance with these indications, we communicate below the rates that will be applied in case of delay:
- € 15.00 up to 30 minutes late (rate applied for each bike included in the reservation)
- € 30.00 from 31 to 59 minutes late (rate applied for each bike included in the reservation)
- € 50.00 for 60 minutes or more of delay (rate applied for each bike included in the reservation).
The rates indicated above will be applied as any delay in delivery leads to an extension of the control/ cleaning/restoration time of the rented item(s), up to the extreme case of not being able to follow up on subsequent bookings, generating a disservice to other customers.
