General rental conditions L'EQUIPE VAINQUEUR, S.L.

By completing this form, the Renter hereby authorizes L’EQUIPE VAINQUEUR, S.L. and KBIKE Cycling Store to register and store his/her personal data for marketing and promotional use.

The Renter acknowledges his/her right to modify any personal information by directly communicating via email with marketing@kbike.es.

L’EQUIPE VAINQUEUR, S.L.U. agrees to delete any user data in case the file where the data is stored disappears.

L’EQUIPE VAINQUEUR, S.L.U. guarantees absolute user data privacy and will not share this information to third parties without any previous authorization from Renter.

Renter information will be part of a file owned by L’EQUIPE VAINQUEUR, S.L.U., of which the information can be found on the “Aviso Legal” page located in www.kbike.es.

This file will only be used in agreement with the “Ley Orgánica 15/1999, de 13 de diciembre, de Protección de Datos de Carácter Personal” and other concordant legislation.

Bicycle Rental Agreement Terms and Conditions:

1) GENERAL CONDITIONS:

1.1) Renter agrees to rent the following bicycle from KBIKE, upon the condition that Renter agrees to all terms and conditions set forth below and evidence that agreement with his/her signature below. 

1.2) The Renter shall return the bicycle to the designated return area clean and in the same condition as it was in when given to Renter, excepting ordinary wear and tear. 

1.3) Renter shall be responsible for any damage caused to the bicycle during the rental period. 

1.4) Bike rental service includes: a mini-inflator pump, rear big, repair bike camera, number 4 Allen key and detachable tools provided to the renter.

2) COVERAGE CONDITIONS:

2.1) Renter assumes and accepts all risks associated with the use of the bicycle. 

2.2) Renter acknowledges that the activities for which the bicycle is designed include inherent dangers, including the risk of bodily injury and/or death. 

2.3) Renter can opt to sign an INSURANCE WAIVER for accident coverage. 

2.4) In the event of damages to the bicycle, Renter shall be billed by KBIKE for the full amount of damages caused by Renter during the rental period, plus an additional 10% fee for general costs. 

2.5) In the case of THEFT, renter compromises to pay KBIKE the full cost of the bike, with taxes included, plus an additional 10% fee for general costs.

3) HIRING CONDITIONS:

3.1) The Renter shall pick up and return the bicycle with the included components to the designated return area. Renter can ask for specific pick up or return places. Renter will assume any additional costs. 

3.2) Renter shall comply with any traffic regulations established in the place where the provided bike is used. 

3.3) This service shall only be provided to people over the age of 18 with legal capacity to hire services such as this. 

3.4) In the case of renting bicycles for use by children or a minor, the person responsible will be the legal guardian and the use of the bicycle will always be conditional on the presence of an adult and their responsibility.

3.5) In case the Renter wishes to terminate the contract and end the bike use before the previously agreed date for causes beyond KBIKE, the company is not obliged to refund the remaining days.

4) RESERVATION CONDITIONS:

4.1) Reservations can be cancelled with no additional costs with up to 72 hours before the reservation date, by sending an email to gestion@kbike.es or by calling the phone number +34 916670381.

In the case of a cancellation with less than 72 hours of anticipation, KBIKE has the right to fully charge the reservation fee with no refund option.

4.2) Confirmed reservations can be modified via email gestion@kbike.es. A successful change will depend on bikes availability. Fees may vary. 

4.3) The reservation is a specific item that can vary depending on the product availability. In case there is no availability, KBIKE is obliged to offer another bike of the same or a higher price without any changes to the renting fee. 

4.4) If KBIKE wishes to cancel the reservation for force majeure, the Renter has the right to ask for a full reservation refund. Causes include but are not limited to climate conditions, pandemic, or any other major causes. 

4.5) KBIKE reserves the right to make any modifications that are deemed appropriate to the rental conditions. 

4.6) Renter accepts that the applicable law for this contract is the Spanish law and is within the Community of Madrid jurisdiction for any possible conflict resolution. 

4.7) Renter shall provide a signed copy of this agreement upon arriving to the designated pick-up place.

5) DATA USAGE CONDITIONS:

Regarding the personal data provided by the renter, he/she agrees to:

5.1) The inclusion of this information to a private database for better services during his/her experience. 

5.2) The disclosure of this data to third parties, for the limited purpose of ensuring that KBIKE is complying with the terms of this agreement and services. 

5.3) The use of this data for marketing and communication purposes.

6) PAYMENT DEPOSIT FOR RENT:

6.1) With each rental, a €250 deposit payment will be requested and it will be returned at the end of the rental. If the bike is picked and returned on the same store, the deposit will be returned immediately. If the bike pickup and return are in different stores, the deposit will be returned within 24H/48H, with a cost of €5 for transfer costs. The means of payment for the deposit can only be by credit or debit card.
