General Rental Conditions
1.Scope of ApplicationThe bike and e-bike rental is operated by STARBIKES SCHWEIZ, which owns the bikes and e-bikes. These General Rental Conditions are an essential part of the rental agreement. By signing, the renter confirms that they have read these conditions and accept them unreservedly.
2.Bike Pickupa) Condition at Pickup
The renter receives the rental bike in a safe and clean condition. Before starting the ride, the bike should be checked for visible damages. If any defects are found, they must be reported to the rental provider or intermediary at the time of handover. A valid ID (e.g., identity card, driver’s license) is required for the handover.
b) Use and Restrictions
The renter commits to obeying traffic laws and handling the bike and accessories carefully. It is prohibited to ride the bike in a condition that impairs reaction ability, e.g., under the influence of alcohol, medication, drugs, fatigue, or illness. The renter is responsible for damages caused by negligence or improper use. Misuse or riding over obstacles that could cause damage are forbidden.
c) Return of the Bike
The renter must return the bike punctually at the agreed location and during opening hours. Late returns or improper parking may incur additional costs, which are to be borne by the renter. The bike and accessories (e.g., chargers, locks, helmets) must be returned complete and in good condition. Damages or losses will be charged to the renter.
3.Extension of Rental Period
An extension of the rental period is only possible with the approval of the rental provider and must be requested before the current rental contract expires. The decision to extend is at the discretion of the rental provider. The new rental price will be calculated accordingly and must be paid upon return.
4.Minimum Age for E-Bike Renters
a) General
Minors under 16 years old may only rent e-bikes with written consent from parents or guardians if not accompanied by an adult.
b) Legal Requirements
For e-bikes with assistance up to 25 km/h, the legal minimum age is 16. Between 14 and 16 years, a category M driver’s license is required. Wearing a helmet is mandatory.
5.Prices and Services
Prices are based on the current price list published in the rental provider’s brochure. These prices include all agreed services. Printing errors are reserved.
6.Cancellations
Reservations can be canceled or modified free of charge up to 48 hours before the rental start. Cancellations within 48 hours of the start will be charged the full amount according to the tariff. Early termination of the rental agreement does not entitle to a refund for unused rental time.
7. Insurance and Liability
a) Accident, Property, and Liability Insurance
The renter is responsible for obtaining appropriate insurance coverage. By renting, they confirm that they have liability insurance that covers all risks associated with riding the bike or e-bike. This insurance also covers costs for assessments, depreciation, repairs, or rental income loss.
b) Defects During Rental
If a defect occurs during the rental period, the renter can exchange the bike at the rental location for a comparable one. The renter is responsible for transporting the bike back to the rental point.
c) Damages, Theft, and Loss
The renter must immediately report any damages or losses to the rental provider. They are liable for damages caused by falls, vandalism, natural events, manipulation, transport, or improper use. Minor damages and material losses will be billed to the renter. In case of theft or loss of the bike or accessories during the rental, the renter bears the costs. The bike must always be secured with a lock.
8. Final Provisions
a) Liability of the Rental Provider
The rental provider assumes no responsibility for damages incurred by the customer in connection with this contract, except in cases of intent or gross negligence. They also exclude liability for indirect damages, consequential damages, damages to third parties, and lost profits.
b) Liability of the Customer
The customer is primarily responsible for damages to the rental bike, in case of non-return or theft, and for violations of the general terms and conditions. This includes costs for assessments, repairs, or loss of use.
c) Insurance
The customer is responsible for their own accident, property, and liability insurance.
d) Legal Jurisdiction
The contract is governed by Swiss law. The place of jurisdiction is Wädenswil.
