RENTAL BICYCLE AGREEMENT AND WAIVER OF LIABILITY

In consideration of The Flandrien Hotel allowing The Client the agreed Equipment the renter has agreed to execute this rental agreement, assumption of risk and release of liability.

Assumption of Risk:  The Client  understands and accept that renting this bicycle and participating in biking exposes me to many hazards and entails unavoidable risk of personal injury and loss of or damage to property. The Client understands the inherent risk involved in using this equipment, accept full responsibility for any and all such damage or injury which may result.

Waiver & Release: In consideration of Flandrien Hotel renting The Client a bicycle, The Client specifically releases and forever discharges Flandrien Hotel and its officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which I may suffer while renting this bicycle or participating in bicycling.

This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damaged caused by the negligence Flandrien Hotel or its officer agents, or employees.

The Client accepts full responsibility for care of the Equipment while it is in his/her possession. The Client agrees to reimburse Flandrien Hotel for any loss or damage other than reasonable wear resulting from normal use. The Client also agrees to reimburse Flandrien Hotel for the replacement cost of any Equipment rented but not returned.

In case of loss or theft of bicycle, a charge of 1500.00 euro will be paid by The Client to Flandrien Hotel. In case of damage to wheel rims due to a bicycle being ridden on a flat tire or ridden over excessively rough surfaces, the repair charge will be 250.00 euro. In case of broken rear derailleur, the repair charge will be 175.00 euro.

The Client agrees that all disputes arising under this contract, the use of this equipment, or from the use of the rental bicycles of the Flandrien Hotel shall be litigated exclusively in Belgium.
