Cycle Together TERMS & CONDITIONS OF HIRE
Cycle Together is delivered by Frome
Community Bike Project on behalf of Frome Town Council and is funded by the
National Lottery through Green and Healthy Frome.
These Terms and Conditions (Terms) apply to the hire of bicycles and related equipment (the “Bicycle”, which includes each bike and each piece of equipment) by you (the Renter) from Frome Town Council (the “Owner/Hirer”) through their agents Frome Community Bike Project.
At the point of booking You (the Renter) accept these Terms.
1. The Bicycle let out on hire, including all accessories & attachments supplied herewith (“the Bicycle”) remains the property of Frome Town Council (“the Owner/Hirer”) and the Renter will not sell, hire out, lend or otherwise part with possession thereof.
2. The Renter must be over 18, in good health and not suffering from any medical condition or disability which is likely to adversely affect normal control of the bicycle.
3. On our Booking Form, we require you to provide personal information such as name, email address and phone number. We will retain this information in accordance with our privacy policy. Your credit or debit card details will be used only for processing payments. A £20 refundable deposit will be taken at the time of booking. You agree to authorise us to charge on that credit/debit card all eventual costs in case of damages, loss or theft of the Bicycle or its components or accessories other than that which can be reasonably classed as normal wear and tear as well as any late return fees that you may owe us. These details are stored within Stripe which is the third party payment system we use for all bike hire transactions in accordance with our privacy policy.
4. Before releasing the Bicycle, the Renter must provide an acceptable form of identification (photo I.D. including name and address which matches the credit/debit card on which payment was made, or other I.D. we agree to accept). If you do not provide acceptable I.D. then we can refuse the hire.
5. The Renter acknowledges and agrees that the Bicycle is in good condition in all respects and undertakes not to misuse it and will return it with all accessories in the same condition as when received (ordinary wear and tear excepted) to the place and on the due date and time specified.
6. If you know you are not going to be able to get back by the end of the Hire Period, then please contact Frome Community Bike Project by calling Emma Parker on 07929 928203 or Alex Hooper on 07968 628700 giving at least 24 hours’ notice to rearrange the end of the Hire Period. Bikes not returned by the agreed time will incur a late return charge of £30 per day.
7. As the Renter, I understand that I am responsible for all equipment relating to this agreement which will include the following accessories: a lock, hi-vis vest, panniers, battery recharger and helmet. I confirm that I will be responsible for the payment of any damage (including third party) caused as a consequence of any dangerous cycling, loss of control, negligence or loss of equipment if the cycles are not locked to a fixed object through the frame and wheel. Proof of lock breakage is required for any insurance claim. T&Cs apply to all accessories.
8. The Renter will lock up the Bicycle whenever it is left unattended and will remove any removable accessories when it is locked in a public place. The lock should go through the frame, a wheel (wherever possible) and a fixed object e.g. cycle rack, bench or lamp post. Overnight the bike will be kept in a secure indoor facility (ie home or locked garage) or locked and covered in a private garden. The Renter agrees to accept liability for the cost of the Bicycle if they fail to secure it as agreed and it is stolen. In the event of the Bicycle being lost or stolen the Owner/Hirer reserves the right to call upon the Renter to indemnify the Owner/Hirer the replacement value of the Bicycle. However, should the Bicycle subsequently be recovered in a useable condition, the Owner/Hirer undertakes to refund the Renter’s Indemnity in full within fourteen days.
9. If the Bicycle or any accessories are lost, stolen, damaged, or involved in an accident, Frome Community Bike Project must be notified as soon as possible on 07929 928203. The Police must be notified immediately if the cycle is stolen and you must obtain a crime reference number. Photographic evidence must be recorded to show the broken bicycle lock or broken door lock where the bike was safely stored.
10. The Bicycle and accessories are supplied in a safe condition by Frome Community Bike Project on behalf of Frome Town Council. The Renter agrees that Frome Community Bike Project and Frome Town Council will not accept liability for damage or injury to the Renter or third parties arising from their use. The Owner/Hirer shall not be liable for any damage caused or loss made whatsoever by breakdown or other defects in the Bicycle or other circumstances beyond the Owner/Hirer’s control. The Renter shall indemnify the Owner/Hirer in respect of all costs, claims, expenses, and demands which it may suffer or incur and which arise directly or indirectly out of the use of the Bicycle during the period of hire.
11. Damage charges, other than which can be reasonably classed as normal wear and tear (Non Exhaustive), will be applied to the Renter. Repairs will be costed as advised by Frome Community Bike Project. Accessory loss/damage will be charged at retail price. The following paragraphs contain advice on how to minimise the risk of paying additional charges due to misuse of the Bicycle:
a. You must not clean Bikes with a jet wash or any pressurised water. If you need to clean the Bicycle before it goes in your vehicle or house then ensure that you do not under any circumstances use a jet wash. Pressurised water or steam will damage bearings and fork seals of the bike.
b. Do not attempt to fix anything you do not know how to fix. Call us if you damage something or something stops working.
c. We do not recommend fitting spd pedals to the Bicycle – being attached to an unfamiliar bike is a bad idea.
d. Ensure spray lubricant does not come into contact with the brake pads or brake rotors or brake discs (WD40, GT85 or spray chain lubricant etc).
e. The seatpost of the Bicycle must be inserted a minimum of 4 inches into the seat tube and the insertion limit lines must not be visible – no matter how tall the rider is.
f. Ensure the Bicycle is transported safely so it is not scratched or damaged. You must use blankets or padding to avoid friction if there is risk of coming into contact with other items. If you take the Bicycle away by vehicle, you are responsible for ensuring that you have an appropriate bike rack or other method of securing the Bicycle to the vehicle which is both safe and will not damage the Bicycle.
12. During the Hire Period, the Renter must check the Bicycle from time to time for damage which may affect their safety. If you find any significant damage, you should not use the Bicycle and return it to Frome Community Bike Project without delay. It is not permitted to continue using the Bicycle if it is damaged when its use can lead to aggravation of the damage or affects traffic safety.
13. It is the Renters responsibility to have insurance cover for damage or injury to themselves or third parties arising from the use of the Bicycle and accessories. Any such claim that arises will not be covered by Frome Community Bike Project or Frome Town Council.
14. The Renter shall be solely responsible for and shall keep the Owner/Hirer fully indemnified in respect of all fines, impositions or other penalties occasioned by the use of the Bicycle during the period of hire in respect of violation of any Acts of Parliament, Orders, Regulations or bye laws for the time being in force.
15. Cycling can be dangerous and has risks involved. By hiring an ebike through this scheme the Renter declares to be in good health and not suffering from any medical condition or disability which is likely to adversely affect normal control of the Bicycle. Safe cycling is dependent on your alertness and good judgement. Please cycle sensibly, with respect for others and the natural habitat. The Renter agrees to: a) not undertake any manoeuvres which are beyond their level of skill or beyond the design purposes of the equipment provided by ‘The Owner/Hirer’; b) not ride on pavements or footpaths and to follow the Highway Code; c) be aware when cycling after dark and use the Bicycle’s fitted lights, bells and wear high vis; d) the Renter will not use the Bicycle under the influence of drink or drugs. You are advised not to cycle when fatigued.
16. The Owner/Hirer will not be responsible for death, injury, loss or damage which results from: the Renters own actions or omissions; the actions or omissions of any third party not connected with the provision of the Bicycle hire; the condition of the road surfaces, weather conditions or other environmental conditions; anything else not caused by the Owner/Hirer.
17. I confirm that I am a competent cyclist. I recognise that I will be riding a bicycle which I may not be familiar with and as such I will exercise additional care and attention. I acknowledge that the hire of the Bicycle includes an initial cycle confidence class with an instructor on collection of the Bicycle from Frome Community Bike Project. The Owner/Hirer strongly recommends that the Renter attends these classes.
18. If the Renter shall commit any breach of the terms of this agreement the Owner/Hirer shall be entitled, but without prejudice, to any other rights or remedies which it may have to terminate the hire of the Bicycle, and recover possession thereof without notice, and to make reasonable charge for such repossession. No rights of the Owner/Hirer under the agreement will be waived except in writing by a duly authorised member of staff.
20. You may cancel your booking up to 24 hours before the rental period is due to start with no charge. If you cancel within 24 hours of the start of your rental you will lose the £20 deposit. You are able to re-book another date, but you’re not guaranteed to have a place.
21. This Agreement is covered by English Law. In the event that any part of the Agreement is for any reason unenforceable the remainder shall remain in full force and effect. By taking part in this scheme I agree to these Terms and conditions.
