These Terms and Conditions apply to all participants (hereafter referred to as the “rider”) using a rental bike and equipment provided by Ride Penang X Bicycle and Beyond Adventures (Bicycle And Beyond Adventures Sdn. Bhd.) (hereafter referred to as “Ride Penang”). Completion of a booking or reservation acknowledges acceptance of these Terms and Conditions, Waiver, and Release of Liability by the participant.

Agreement
I (the rider) have carefully read this agreement in its entirety and understand its content. I acknowledge this as an assumption of risk, waiver, and release of liability, and I agree to it voluntarily.

Hire Terms and Conditions

Rider Responsibilities

1. Each rider agrees they are physically and mentally capable of riding the rental bike.
2. Riders are fully responsible for their actions while using the rental bike. Ride Penang does not accept responsibility for actions taken by the rider or the consequences of such actions.
3. Riders must ensure they have adequate insurance coverage while using a rental bike. Any accident or injury caused by the rider’s actions will be the full responsibility of the rider.
4. Each rider will be responsible for any fees or costs arising from an accident involving or caused by the rider.
5. Ride Penang requires all riders to wear a cycling helmet at all times for safety.
6. Riders may not use a rental bike if under the influence of alcohol or drugs.

Rider Responsibility for Damage, Loss, Theft & Returns

1. At the time of rental, Ride Penang may place a hold on the rider’s payment card. This hold will be released upon return of the rental bike without damage.
2. Bikes are rented clean and in good working condition and must be returned in the same manner.
3. Bikes are maintained in a roadworthy condition; however, it is the responsibility of the rider to check the bike before setting out on any ride.
4. The rider agrees to return the bike directly to Ride Penang staff. Failure to return the bike will result in the rider being charged the full retail value of the bike.
5. The bike must be returned in clean, undamaged condition to avoid additional charges for repair, maintenance, or replacement. Normal road grime is accepted; however, bikes not returned clean may incur a cleaning fee.
6. Any damage beyond normal wear and tear is the responsibility of the rider. Damaged parts or components will be repaired or replaced at Ride Penang’s discretion, and the rider agrees to cover associated costs.  
7. The rider authorizes Ride Penang to charge their payment card for any costs arising from damage to the bike during the rental period, inclusive of labor. In the event of theft, the rider will be responsible for reimbursing Ride Penang for the original cost of the bike and any provided accessories.

Picking Up or Receiving Your Rental Bike

1. Proof of identification, such as a passport or Malaysian ID, may be requested to confirm identity at time of delivery.
2. Ride Penang will endeavor to provide the bike(s) as booked but reserves the right to substitute for bikes of similar value and type if necessary.
3. Ride Penang reserves the right to refuse service to anyone with inappropriate equipment or clothing.

Age Restrictions

1. Riders under 16 must be accompanied by an adult. A person aged 18 or over must complete the booking form, and proof of age may be requested.

Changes and Cancellations

1. For booking changes, contact us at least 24 hours in advance to reschedule based on availability.
2. Cancellations incur fees based on timing:

• Up to 2 weeks before: 5% administration charge.
• Up to 1 week before: 20% of the hire value.
• Up to 3 days before: 50% of the hire value.
• 1 day before: 75% of the hire value.
• Day of the event: Full charge applies.

Assumption of Risk, Waiver, and Release Agreement

Understanding The Risk

The rider acknowledges that cycling involves inherent risks, which may include accidents due to other bicycles, road conditions, or unforeseen hazards, potentially resulting in serious injury or property damage. The rider confirms they are in good physical health to participate and understands the importance of wearing a helmet as a rental condition.

Waiver and Release

By accepting these Terms and Conditions, the rider waives any liability claims against Ride Penang and its affiliates, officers, agents, and employees for any injury, illness, death, or loss of or damage to property incurred during bike rental and use. This waiver includes claims arising from Ride Penang‘s negligence or breach of contract.

Malaysian Jurisdiction

This agreement shall be governed by and interpreted in accordance with Malaysian law, and any disputes will be subject to the exclusive jurisdiction of the courts in Malaysia.
