Bike Hire

In the contract below ‘I’ refers (the hirer) : Cyclefit LTD (the company)

I agree on collection of the rental bicycle I will let Cyclefit take my card details and take a photo of my ID. If the rental bicycle is damaged when returned, we will charge the card the cost of the repair. If the bicycle is not returned or stolen, the hirer will be charged the value of the bicycle.

Bike equipment can only be hired to a person of 18 years and over. The hirer takes full responsibility for the use of the equipment, themselves or any third party using the equipment. If the hirer is hiring the equipment for the use by a person under 18 years of age the hirer/payer of the equipment takes full and complete responsibility for the person under 18 years of age and that they agree that the equipment is fit for purpose, safe and that a full and complete risk assessment of the area and or route which the equipment is to be used is safe to do so. Also, that any person/s of any age using any equipment is wearing the correct safety clothing whether provided by Cyclefit or not.

Assumption of Risk: I understand and accept that renting this bicycle and participating in the activity exposes me or others to many hazards and entails unavoidable risk of death, personal injury (including but not limited to severe spinal or head injury) and loss of or damage to property. I also understand I or any other user should be in good physical health to participate in bicycling or using skate equipment. I or any other user chooses to participate in bicycling equipment in spite of these risks and hereby assume all risk of injury or loss of life to myself and other persons using the equipment and loss of or damage to property arising out of renting this equipment. I understand the inherent risk involved in using this equipment and accept full responsibility for any and all such damage or injury which may result to me or any other person.

Waiver & Release: In consideration of Cyclefit renting me this bicycle, I specifically release and forever discharge Cyclefit and its officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which I or another user may suffer while renting this equipment. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damaged caused by the negligence of Cyclefit or its officer agents, or employees. It is my intent by the Waiver and Release Agreement to release Cyclefit and hold harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by negligence of Cyclefit or whether based upon breach of contract, breach of warranty, or any other legal theory.

In signing this document, I fully recognize that if injury, illness, death or damage occurs to me while I am engaged in renting this bicycle or using skate equipment or participating in bicycling or skating, I will have no right to make a claim or file a lawsuit against Cyclefit, its officers, agents or employees, even if they or any of them negligently cause my injury, illness, death or damage.

I REALISE THE IMPORTANCE OF WEARING A HELMET & APPROPRIATE CLOTHING AND I HEREBY COMMIT TO WEARING A HELMET AT ALL TIMES WHILE RIDING.

I am fully responsible for any theft or damage while the equipment is under my hire whether the equipment is securely locked or not.

I understand that this activity may result in severe injury, including but not limited to spinal or head injury. I understand that this activity may result in hazards posed by other bicycles and traffic or road conditions. I understand how to operate the rental bicycle and equipment. Cyclefit staff have answered any questions that I have.

I HAVE CAREFULLY READ THIS AGREEMENT AND UNDERSTAND ITS CONTENT. I AM AWARE THIS IS AN ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND I SIGN IT VOLUNTARILY. I ALSO UNDERSTAND THAT I SHOULD NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.

I am to take full responsibility for either intentionally or unintentionally allowing any other person of any age or ability the use of this hired equipment.

I understand that whilst on Cyclefit property, high definition audio and visual security equipment is being used and recordings are taken as part of my hire agreement and that if needed these recording may be used in any future proceedings or identity purposes.

Cancellations

Please note: in the event of a cancellation that is requested by a customer, and not the fault of the business, refunds will be minus any transaction fees incurred. The company reserves the right to refuse bookings or order requests. In the event of a cancellation:

100% with over 4 weeks notice.
75% within 4 weeks notice.
50% within 2 weeks notice.
No refund within a week.

Failure to return the equipment at the time agreed when booking will incur, a per equipment, penalty of £10 and additional £20 per hour, or part thereof.  

I accept that I am responsible for the replacement value of the equipment if lost or the cost of repair if damaged. I understand that I have sole responsibility during my hire period and that insurance cover is my responsibility, and not offered to me by Cyclefit as part of my hire.

Please note: We do not offer a repair or collection service during your hire period. The bicycle and equipment are handed over in the best possible condition and you have sole responsibility during your hire period. The bikes do not come with a maintenance package. We can assist with small items for puncture repair should you arrive without. It is the hirers responsibility to equip themselves as they see fit. We will supply a puncture repair kit and small pump with the hire of the bike. It will be up to the hirer to have the correct equipment for the repair of any major technical problem.

Bikes equipment should be returned in a similar condition to when they are handed over at the start of your hire. If Bikes are returned, for example covered in mud, with no attempt to wash down, customers will be charged a cleaning fee. A standard wash will be charged at £5 (per bike). I accept these charges if I do not or cannot return the bike in the condition they were handed over to me. By accepting the bikes and continuing with my hire, I agree the bike equipment at the start of my hire are in the best possible condition.
