Easy Riders eBikes Rental Terms and Conditions and Waiver
These Terms and Conditions (“the T&Cs”) apply to all participants (herein after referred to as “riders”) using a hire ebike provided by Easy Riders (herein after referred to as “Easy Riders”).
Completion of an on-line booking / reservation acknowledges acceptance of these T&Cs, Waiver and Release of Liability by the person completing the booking (hereinafter referred to as the “hirer”). It is the hirer’s responsibility to ensure that all riders are aware of the Terms and Conditions and Waiver contained herein and that they comply with them. All riders are therefore bound by this document.
The hirer agrees to the Terms and Conditions and the Waiver and accepts responsibility for any children under the age of 18 that are riders.
Agreement
I (the rider) have carefully read this agreement in its entirety and understand its content.
I am aware this is an assumption of risk, waiver and release of liability and I agree to it voluntarily.
Hire Terms and Conditions
Rider Responsibilities
In this agreement, the term “bike” and “ebike” includes the helmet and lock where included within the hire and relevant to the context.
1. Each rider agrees that they are physically and mentally capable of riding the hire bike and are aged 14 or over, they are a minimum of 162.5cm/5’ 5”/maximum of 1.88cm/6’ 2”in height and do not have any pre-existing medical condition that would preclude the use of the e-bikes or affect their use of the e-bikes and that their eyesight is of the required standard for driving on public roads. If the rider lacks the physical and mental capability to ride an ebike and has to abort their ride, they will be responsible for transporting the ebike back to Easy Riders storage unit and any costs incurred.
2. The rider is fully responsible for their action whilst using the bike and Easy Riders expects the rider to cycle in a sensible manner, with consideration for other road/bike path users. Easy Riders does not accept responsibility for the actions of the participant nor the consequences of such actions.
3. The rider understands the UK Highway Code and in particular the ‘Extra Rules for Cyclists’ (Rules 187-211) and understands that they should keep to the left on unmarked roads and will under no circumstances use the ebike/s on public pavements or footpaths. Code of conduct: Show respect for other road/trail users, walkers have the right of way, the cycleway is not a racetrack and when passing people please slow down and ring bell when overtaking.
4. The rider is not to use cameras, portable music devices, phones or other electronic devices whilst riding the bike.
5. Each rider is responsible for providing their own insurance protection while using a hire bike. Any accident or injury caused by the rider’s actions will be the full responsibility of said rider.
6. Each rider will be fully responsible for any fees or costs incurred or arising from an accident either involving or caused by the rider.
7. Easy Riders requires all riders hiring from us to wear the cycle helmet provided at all times.
8. The rider may not participate in this activity if under the influence of alcohol or drugs.
Rider Responsibility for Damage, Loss and Theft
9. At the time of rental Easy Riders will securely hold details of the rider's Payment Card and reserves the right to charge the Card for any damage or loss.
10. Bikes are rented out clean and in proper working condition and must be returned in the same manner. Each bike is assessed and checked for damage before being made available to hire and it is the rider’s responsibility to check that the bike is undamaged on collection (aside from scratches to paintwork) and to immediately inform Easy Riders if the bike is damaged and to refrain from removing it from the bike storage unit.
11. Ebikes must not be submerged in water, cycling in rain is fine, but deep puddles must be avoided.
12. Easy Riders ebikes are not suitable for off-road use and must only be ridden on roads or paved cycle paths.
13. Bikes are maintained in a roadworthy condition; however, it is the responsibility of the rider to check the bike before setting out on any ride.
14. The rider agrees to return the bike to Easy Riders bike storage unit and to lock it securely in its charging station using the lock provided at all times. Failure to return the bike will result in Easy Riders recovering the full retail value of the bike from the rider.
15. The rider agrees to return the bike in clean, undamaged condition to avoid any additional charges for the repair, maintenance or replacement. Bikes should be returned clean of mud and debris – normal road grime is accepted. Any Bikes not returned clean may attract a cleaning fee. Undamaged condition means normal wear and tear is accepted but does not include broken spokes, rims, bent rims, damaged frames, handlebars, seats or other parts from misuse and/or crashes. The rider is responsible for any negligent damage caused to the bike. Damaged parts or components will be repaired/replaced at Easy Riders’ discretion and the customer agrees to pay either the cost incurred by Easy Riders or the regular shop rates/retail price (whichever is higher) for components replaced.
16. The rider authorises Easy Riders to charge the rider's payment card for all eventual costs in case of damage to the eBike(s) during the rental period, comprehensive of labour. In case of theft, the rider will be responsible for reimbursing Easy Riders for the original price of the e-Bike(s), plus the cost of any accessories that were provided at the time of the bike rental.
17. Bicycle locks are provided and ebikes must be locked to a permanent fixture whenever they are left unattended.
18. All equipment must be returned to the agreed collection point at the correct time as indicated on the booking form. No refunds or reductions will be given for any equipment returned early.
19. For bikes hired by the half day, any bike that is returned more than 15 minutes late will be charged at an hourly rate of £5 thereafter.
20. Bikes hired for the day and not returned within 15 minutes of the return time, as stated on the hire agreement, will incur a late return charge of £5 for any period after this up to the first hour and an additional half day’s hire charge for all bikes over an hour late.
21. Bikes not returned on the same day of the return time will incur a full day’s hire charge for each day thereafter until returned.
22. If you know that you are not going to get back by the agreed time, then please call and let us know – these charges will only be waived in exceptional circumstances.
Picking Up Your Rental Bike
23. Proof of identification must be provided via our online portal on our website (e.g. driving licence, passport). Only nationally recognised forms of ID will be accepted i.e. Photo driving license or passport.
24. We will endeavour to provide the bike(s) which you have booked, but we reserve the right to substitute your booked bikes for a bike(s) of the same value.
25. It is the Rider’s responsibility to wear clothing appropriate for road cycling .
Age Restrictions
26. Age restrictions apply for bikes. Children must be at least 14 years old to rent an ebike from Easy Riders. Riders under the age of 18 must be accompanied by an adult aged 18 or over. The booking form must be completed by a person aged 18 years or over. You will be asked to confirm that you are aged 18 or over via our on-line booking system.
Changes and Cancellations
27. Changes to bookings: Contact us at least 24 hours beforehand to change your booking to another day of your choice (subject to availability).
28. Cancellations: Full Payment is collected on booking the bike. Our cancellation policy is as follows:
Up to 2 weeks before the event or hire date – 5% of the value of the hire shall be retained by Easy Riders as an administration charge.
Up to 1 week before the event or hire date – 20% of the value of the hire shall be retained by Easy Riders.
Up to 3 days before the event or hire date – 50% of the value of the hire shall be retained by Easy Riders.
1 day before the event – 75% of the value of the hire shall be retained by Easy Riders.
Day of event. – Full charge will be taken.
Assumption of Risk, Waiver and Release Agreement
29. This agreement is personal to the rider and the rider shall not assign, transfer, charge or deal in any other manner with any of its rights and obligations under this agreement.
30. If at any time Easy Riders finds the rider to be in breach of its responsibilities and commitments under the terms of this booking, then:
(a) Easy Riders’ consent to the rider’s possession of the e-bike shall terminate;
(b) Easy Riders may, by its authorised respresentatives, without notice and at the rider’s expense, retake possession of the bike and for this purpose may enter any premises at which the bike is located;
(c) The rider shall have no right to a refund
(d) Any provision of this agreement that expressly or by implication is intended to come into or continue in force on or after termination or expiry of this agreement shall remain in full force and effect.
31. Termination or expiry of this agreement shall not affect any rights, remedies, obligations or liabilities of the parties that have accrued up to the date of termination or expiry, including the right to claim damages in respect of any breach of the agreement which existed at or before the date of termination or expiry.
Assumption of Risk, Waiver and Release Agreement
Understanding The Risk:
The rider understands and accepts that there are inherent and unavoidable risks involved in participating in bicycling on a public highway, cycle route, thoroughfare or track.
The rider understands that participating in bicycling may also result in hazards posed by other bicycles, pedestrians, horse riders and traffic or road conditions.
The rider understands that this activity may result in death or severe injury, including but not limited to spinal or head injury.
The rider understands that this activity may result in loss of or damage to property.
The rider understands they should be in good physical health to participate in bicycling, and confirms that they have no significant health issues that prevent them from participating in bicycling.
The rider understands the importance of wearing a helmet and that it is a condition of rental from Easy Riders that a helmet must be worn at all times and provides a helmet free of charge with each ebike hire.
The rider understands that they should not and may not participate in this activity if under the influence of alcohol or drugs.
Waiver and Release:
In agreeing to these terms and conditions, waiver and release, the rider confirms they understand the inherent risk involved in using this rental bicycling equipment and accept full responsibility for any and all such damage or loss of life or injury which may result.
In consideration of Easy Riders renting this bicycle, the rider specifically releases and forever discharges Simon Barker, Catherine Barker, Easy Riders and its affiliates, officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damage to property which the rider may suffer while renting this bike and participating in bicycling.
This discharge specifically includes, but is not limited to, liability or claims for damage caused by the negligence of Easy Riders or its affiliates, officers, agents, or employees.
The rider confirms it is their intent by the Waiver and Release Agreement to release Easy Riders, Simon Barker and Catherine Barker and hold them harmless from all liability for any such property loss or damage, personal injury or loss of life, whether based upon breach of contract, breach of warranty, or any other legal theory.
By confirming for a minor, the rider agrees that they are their parent or legal guardian and are releasing Easy Riders, Simon Barker and Catherine Barker from any claims, lawsuits or responsibilities for that minor. Each of the riders has read this agreement for use of bikes and release and waiver of liability (extra copies are available at the bike pick-up point location).
The rider shall indemnify Easy Riders in full against all liabilities, costs, expenses, damages and losses (including any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other reasonable professional costs and expenses) suffered or incurred by Easy Riders, Simon Barker or Catherine Barker arising out of, or in connection with any failure by the rider to comply with the terms of this agreement.
Jurisdiction of Law
This agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation.
Severance
If any provision or part-provision of this agreement is or becomes invalid, illegal or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of this agreement.
Rights and Remedies
Except as expressly provided in this agreement, the rights and remedies provided under this agreement are in addition to, and not exclusive of, any rights or remedies provided by law.
